Transparency unit staffing and budget

Dear Sir or Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the years 2017, 2018 and 2019:

- any and all documents that contain the number of staff in your Transparency Unit (or the department dealing with access to EU documents requests) - this could be, for instance, organigrams or staffing plans that are specific to that unit;
- any and all documents containing the budget for your Transparency Unit (or the department dealing with access to EU documents requests); I would appreciate the most detailed version of this budget possible.

And for the years 2016, 2017 and 2018:

- any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.

Dear Ms Izuzquiza, With regard to your application for access to documents – namely “Transparency unit staffing and budget [#136162]” - we apologize for the late reply. The Agency processed your application in line with the provisions of Regulation (EC) No. 1049/2001 of the European Parliament and of the Council regarding public access to documents. As for your first point (“For the years 2017, 2018 and 2019: any and all documents that contain the number of staff in your Transparency Unit [or the department dealing with access to EU documents requests”) please note that EMSA does not have a “Transparency Unit” or staff exclusively devoted to handle requests for access to documents. Applications for access to documents under Regulation (EC) No. 1049/2001 are dealt with by the Agency’s Executive Office. The Head of the Executive Office has been appointed as Document Access Coordinator by Decision No. 2012/024 of the Executive Director. The arrangements to be applied by the Agency in order to provide public access to EMSA documents have been laid down in a decision of the Agency’s Administrative Board of 19 March 2013, which provides an overview of EMSA’s approach to requests for access to documents and which is available on EMSA’s website (“Decision amending the Decision on public access to documents.pdf” http://emsa.europa.eu/who-are-we/admi.... We are not in a position to provide access to documents that contain the number of staff in the Agency’s Transparency Unit as such documents do not exist. As for your second point (“For the years 2017, 2018 and 2019: any and all documents containing the budget for your Transparency Unit [or the department dealing with access to EU documents requests”) please refer to the answer above. There is no Transparency Unit in EMSA, and therefore there is no dedicated budget for such activity. As for your third point (“And for the years 2016, 2017 and 2018: any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.”) we can provide you with the following broken down data: • In year 2016: 1 initial application for access to EMSA documents was made; no confirmatory application was made. • In year 2017: 11 initial applications for access to EMSA documents were made; no confirmatory application was made. • In year 2018: 22 initial applications for access to EMSA documents were made; no confirmatory application was made. Please note that according to Article 7(2) of Regulation (EC) No. 1049/2001 of the European Parliament and of the Council regarding public access to documents you may make a confirmatory application within 15 working days of receiving this e-mail, asking the Agency to reconsider its position.
