Transparency unit staffing and budget

Dear Sir or Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the years 2017, 2018 and 2019:

- any and all documents that contain the number of staff in your Transparency Unit (or the department dealing with access to EU documents requests) - this could be, for instance, organigrams or staffing plans that are specific to that unit;
- any and all documents containing the budget for your Transparency Unit (or the department dealing with access to EU documents requests); I would appreciate the most detailed version of this budget possible.

And for the years 2016, 2017 and 2018:

- any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.

Dear Ms. Izuzquiza We refer to your e-mail dated 3rd May 2019 in which you make a request for public access to documents pursuant to Regulation (EC) No 1049/2001 relating to the staffing and budget of the “Transparency Unit”. In your email, you ask access to: “For the years 2017, 2018 and 2019: - any and all documents that contain the number of staff in your Transparency Unit (or the department dealing with access to EU documents requests) - this could be, for instance, organigrams or staffing plans that are specific to that unit; - any and all documents containing the budget for your Transparency Unit (or the department dealing with access to EU documents requests); I would appreciate the most detailed version of this budget possible.” In relation to this aspect of the request, please note that ENISA does not have a specific Transparency Unit. Accordingly, there is no ENISA document containing information on the allocation of FTEs or budget to this area of activity. Please note that according to the established case law of the Court of Justice of the European Union, Regulation (EC) No 1049/2001 may not be relied upon to oblige an institution to create a document which does not exist. Consequently, ENISA is not in a position to provide you with documents that meet the description contained in this part of your request. For information purposes, please find attached the ENISA policy on Public Access to Documents requests. In line with this policy, which provides an overview of ENISA’s approach to such requests, the Agency has a public access to documents coordinator function that is currently assigned within the ENISA Policy Unit. In addition to the requested information that is quoted above, you also ask access to: “[…] for the years 2016, 2017 and 2018: - any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.” With regard to this second part of your request, please find attached an overview containing the relevant information for the years in subject. Dear ENISA, Thank you! I hereby confirm receipt of your response and the disclosed documents. In regards to the first part of my request, I understand that ENISA does not have a Transparency Unit and that therefore there are no documents that hold the information I'm seeking access to. Would the agency, however, be able to provide the number of staff (full-time and/or part-time) that handle access to documents requests within the agency? Many thanks in advance. Dear Ms. Izuzquiza We refer to your e-mail dated 7th June 2019 in which you ask for clarifications following our reply to your request for public access to documents pursuant to Regulation (EC) No 1049/2001 relating to the staffing and budget of the "Transparency Unit". As indicated in our initial reply, ENISA does not have a specific Transparency Unit nor any dedicated FTEs for handling public access to documents requests. There is however a public access to documents request coordinator within the Agency's Policy Unit who monitors and coordinates replies. Please also note that the replies to public access to documents requests are drafted within the organisational unit/team which is responsible for the subject area of the request, and thus staff is assigned to requests on a case-by-case basis.
