Transparency unit staffing and budget

Dear Sir or Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the years 2017, 2018 and 2019:

- any and all documents that contain the number of staff in your Transparency Unit (or the department dealing with access to EU documents requests) - this could be, for instance, organigrams or staffing plans that are specific to that unit;
- any and all documents containing the budget for your Transparency Unit (or the department dealing with access to EU documents requests); I would appreciate the most detailed version of this budget possible.

And for the years 2016, 2017 and 2018:

- any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.

It appears that you are requesting access to documents that contain specific information. Please note that Regulation (EC) No 1049/2001 applies only to requests for access to existing documents, i.e. “any content whatever its medium (written on paper or stored in electronic form or as a sound, visual or audio-visual recording) concerning a matter relating to the policies, activities and decisions falling within the institution's sphere of responsibility” (Article 3 of Regulation (EC) No 1049/2001). As your request relates to information which is not contained in existing documents, and replying would involve compiling information from a number of different documents, it should be considered as a request for information to be processed in accordance with the Code of Good Administrative Behaviour. The ERCEA will collect the information and data and will present them to you in a clear and detailed manner so your request is satisfied to the fullest extent.  Following the above and in accordance with the Code of Good Administrative Behaviour, you shall receive a reply from the ERCEA in 15 working days (by 11/6/2019). Please note that this reply relates only to information within the remit of the ERCEA. Concerning your question on the number of staff in and budget for ERCEA’s transparency unit, please note that the ERCEA does not have a transparency unit, as apparent from the organization chart of the ERCEA available on the website of the European Research Council: [https://erc.europa.eu/sites/default/f...](https://erc.europa.eu/sites/default/f...) For your information, within the ERCEA it is the Central Contact Point (CCP) that deals with all requests for public access to documents held by the ERCEA. The CCP has been established within the ERCEA’s Legal Affairs and Internal Control Unit (Legal Unit) with a designated staff member having legal background. There is additional administrative assistance within the Legal Unit ensured for the non-legal, administrative type of work with access to document requests. Besides the Legal Unit, other units can also be involved e.g. the ERCEA service holding the document that cooperates with the Legal Unit in the preparation of the reply. The Data Protection Officer (DPO) provides advice in cases where the request of access to documents fully or partially concerns documents containing personal data. Furthermore all draft replies are verified and approved by management. As you can see, access to document requests are not dealt with by a single unit but by various actors on different levels within the ERCEA. In addition, the colleagues dealing with access to document requests within the Legal Unit are assigned also various other type of legal tasks. Since your request relates to transparency, it shall also be noted that various services within the ERCEA reply to numerous requests for information they receive from the public, which are handled in accordance with the Code of Good Administrative Behaviour. Concerning the handling of access to documents requests by the ERCEA, please find attached the table containing the requested data:  the number of initial access to documents applications and the number of confirmatory applications received for the years 2016, 2017 and 2018 by the ERCEA.
