Transparency unit staffing and budget

Dear Sir or Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the years 2017, 2018 and 2019:

- any and all documents that contain the number of staff in your Transparency Unit (or the department dealing with access to EU documents requests) - this could be, for instance, organigrams or staffing plans that are specific to that unit;
- any and all documents containing the budget for your Transparency Unit (or the department dealing with access to EU documents requests); I would appreciate the most detailed version of this budget possible.

And for the years 2016, 2017 and 2018:

- any and all documents containing data on the handling of access to EU documents requests by this institution; I am looking specifically for broken down data, per year, on the number of initial access to documents applications received, and the number of confirmatory applications received.

Dear Ms. Izuzquiza, Thank you for your email dated 3 May 2019. As communicated to you by email on 3 June 2019, your request will be handled under the Code of Good Administrative Behaviour. Please see below some information referred to in your request: DG CLIMA does not have a Transparency Unit as such. The access to documents function is managed by Unit DG.01 (Legal, Inter-institutional Relations and Communication) since 1 January 2019 and by Unit A1 (International and Inter-institutional Relations) during the years 2017 and 2018. Document management functions are under the responsibility of Unit A4 since 2017. There are no documents that contain the organigramme of the Units that have managed access to documents. The general organisation chart of the Directorate-General for Climate Action is accessible via the link below: https://ec.europa.eu/clima/about-us/chart_en Specific information on the names or functions of the staff working in the Units cannot be provided as it is protected under the Data Protection Regulation. Article 3(1) of Regulation 2018/1725 provides that personal data ‘means any information relating to an identified or identifiable natural person […]’. The Court of Justice has specified that any information, which by reason of its content, purpose or effect, is linked to a particular person is to be considered as personal data. (Case C-434/16<http://curia.europa.eu/juris/document/document.jsf?text=&docid=205882&pageIndex=0&doclang=FR&mode=lst&dir=&occ=first&part=1&cid=485626>, Peter Nowak v Data Protection Commissioner). In this respect, the names or functions pertaining to staff members of an institution are to be considered personal data (T-39/17<http://curia.europa.eu/juris/document/document.jsf?text=&docid=205882&pageIndex=0&doclang=FR&mode=lst&dir=&occ=first&part=1&cid=485626>, Port de Brest v Commission). As regards the second point of your request, the Access to Documents function was never allocated to any specific administrative or operation budget. Please note that the staff responsible for access to documents do not hold this as their only function and it is not possible to disaggregate the specific budget for the function. Therefore, we do not hold any document that could contain this information. Do not hesitate to contact us again if you need further information.
