Anfrage an: Asylagentur der Europäischen Union

Dear European Asylum Support Office,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, we are requesting the following documents:

- Any and all guidelines, policies, instructions, rules, recommendations or regulations of any kind held by the EASO with regards to costs relating to litigation before the General Court of the EU and the European Court of Justice.

In particular - although not exclusively - we are interested in any and all documents related to or regarding:

- How and when the EASO decides whether it relies on external services, may it be external lawyers or other experts, and any considerations and criteria taken into account throughout this decision-making process;
- How the EASO calculates legal costs to be claimed when it wins a legal challenge before the EU court, and any considerations and criteria taken into account throughout this decision-making process;
- How and when the EASO decides to claim these costs, and any considerations and criteria taken into account throughout this decision-making process; or
- Whether the EASO contemplates or establishes limits, reductions or waivers to legal costs, and any considerations and criteria taken into account throughout this decision-making process.

We hereby acknowledge receipt of your application for access to documents under Regulation (EC) No 1049/2001, which was registered under reference number 00107 on 12 January 2022. In accordance with Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council and Commission documents and Decision No 6 of the Management Board of EASO laying down practical arrangements regarding public access to documents of EASO, your application will be handled within 15 working days from the day of registration. The (initial) time limit is set to expire on 2 February 2022. In case this time limit needs to be extended, you will be informed in due course. Dear Ms Izuzquiza, Reference is made to your correspondence dated 11 January 2022, which was registered by the former EASO on 12 January 2022 under reference number 00107. As a preliminary remark, please be informed that EASO has in the meantime been replaced and succeeded by the European Union Agency for Asylum (EUAA) following the entry into force of Regulation (EU) 2021/2303 of the European Parliament and of the Council of 15 December 2021 on the European Union Agency for Asylum and repealing Regulation (EU) No 439/2010, (OJ L 468, 30.12.2021, p. 1). Your request (No 00107) has been treated as an application for public access to documents falling under the provisions of Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents, in accordance with Management Board Decision No 6 of 20 September 2011 laying down practical arrangements to the documents of the European Asylum Support Office (EASO). Having carefully examined your request and after having consulted the relevant internal entities, please be informed that the EUAA does not hold any relevant documents.
