Agreement regarding new reception centres in Greece

Dear Directorate-General for Migration and Home Affairs,

The European Commission document of 3 December 2020, titled “Memorandum of Understanding: Commission support for the situation on the Greek islands Questions and Answers”, states:

“In November 2020, the Commission signed a grant agreement with the Greek authorities for the
construction of 3 new reception centres on the Greek islands of Samos, Kos and Leros.”

To this regard, under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

- the aforementioned grant agreement signed with the Greek authorities, including all relevant annexes.

Dear European Commission, Please pass this on to the person reviewing confirmatory applications. On 29 March 2021 I submitted an access to documents request for “the grant agreement signed with the Greek authorities, including all relevant annexes.” This was in reference to the agreement signed in November 2020 “for the construction of 3 new reception centres on the Greek islands of Samos, Kos and Leros.” My initial request as well as all subsequent correspondence can be found here: https://fragdenstaat.de/anfrage/agree... On 27 April, DG Home responded to my request refusing access to all documents identified, namely: “Grant Agreement, Reference Number: HOME/2020/AMIF/AG/EMAS/0127 (24/11/2020)” as well as 9 additional documents. DG Home refused access to these documents on the basis of Article 4 (2) first indent and (3) of Regulation 1049/2001. To this extent, I hereby argue: 1. DG Home’s application of Article 4 (2) first indent is unlawful and contravenes established EU case law. In its response, DG Home argues that the requested documents “contain commercially sensitive information of the Member State that submitted them”; “information relating to methodologies, internal organisation, particular know-how, strategy and other country specific proprietary information with competitive value.” DG Home also argues that disclosure would undermine “the protection of the interests of the Member State that submitted it, as putting this information in the public domain would affect its future competitive position”. On the one hand, DG Home claims that the protection of commercial interests can be applied in this case since “The exception relating to commercial interests can also be applied to non-commercial entities”. This must be disputed. The case law cited by DG Home indeed refers to a non-commercial entity: a university. DG Home cannot however seriously argue that an EU Member State can be considered as a “non-commercial entity” subject to Article 4 (2) first indent of Regulation 1049/2001; the case law cited is simply not applicable. Furthermore, the documents in dispute refer to a grant agreement between an EU Member State (Greece) and the European Commission. This means that public funds will be invested into a project and a series of services run and/or coordinated by public authorities at a national level. Furthermore, the grant agreement in question relates to reception centres meant to host asylum-seekers in the Greek islands, and therefore entails an important series of considerations regarding the protection of human rights and compliance with international law in European soil. To this extent, the protection of commercial interests not only does not apply, but in fact transparency and proper accountability becomes of upmost importance. It must be recalled that these “reception centres” will be built in order to address the failures of previous reception centres such as the Moria camp in Lesvos, now entirely destroyed due to a fire. The European Commission has repeatedly stated that it will provide adequate, human rights-compliant reception conditions in the future, and that it will be transparent about it. This means that not only that not only the exception applied in this case is not applicable, but that the overriding public interest in the disclosure of these documents is undeniable. Furthermore and in any event, I would like to recall that according to well-established case law, EU authorities must demonstrate how disclosure would “specifically and actually” undermine an interest protected under Article 4 of Regulation 1049/2001. Authorities must also demonstrate how this risk is “reasonably foreseeable and not purely hypothetical”. DG Home’s response and refusal contravenes the cited case law. In its response, DG Home fails to explain specifically how disclosure would undermine the commercial interests of the Greek state. Instead, DG Home merely describes the procedure for awarding these contracts and very vaguely describes the nature of the information contained in the disputed documents. This argumentation cannot seriously be considered as compliant with the criteria established by the EU court. 2. DG Home’s application of Article 4 (3) first subparagraph is also unlawful and also contravenes established EU case law. First, it must be recalled that Article 4 (3) first subparagraph of Regulation 1049/2001 states that “Access to a document, drawn up by an institution for internal use or received by an institution, which relates to a matter where the decision has not been taken by the institution, shall be refused if disclosure of the document would seriously undermine the institution's decision-making process”. The documents in dispute do not relate to “a matter where the decision has not been taken”; they are in fact an agreement, signed only once a decision was taken with regards to the grant in question. DG Home argues that “The documents that you have requested are meant to serve inter alia as a reference tool for the monitoring of the project implementation towards the achievement of the results and outputs”; “the Commission receives information from the beneficiary, on a regular basis or whenever necessary, based on which various measures could be taken, including decisions on the future implementation of the grant agreement.” First, the description offered by DG Home is not that of an ongoing decision-making process, but merely the process of implementing a contract. The fact that in the coming years isolated decisions “could be taken” does not qualify as an ongoing decision-making process in the sense of Article 4 (3) first subparagraph of Regulation 1049/2001 If this were to be the case, every document related to any EU line of work would immediately be subject to an ongoing decision-making process and fall under the exception laid out in Article 4 (3) of Regulation 1049/2001, since every piece of information contained in a document can eventually trigger a decision at any given moment. This, however, is not the meaning of Article 4 (3) of Regulation 1049/2001, which is rather subject to the principle of widest possible access. To this extent, DG Home’s application of the exception is unlawful, as the documents in dispute relate to a decision-making process that is now final; the grant agreement and annexes are, in fact, the culmination of the decision-making process. Furthermore, DG Home’s arguments once again contravene EU case law establishing that the risk of disclosure must be “reasonably foreseeable and not purely hypothetical”. DG Home in fact states that “measures could be taken, including decisions”, thereby presenting a scenario that is entirely vague and hypothetical by definition. DG Home also fails to demonstrate how “specifically and actually” the protected interest would be undermined. Finally, DG Home argues that “awards are founded on a relationship of trust between the contracting parties”, and that “the grantees must be able to communicate any relevant information to the contracting authorities, in particular for the purpose of project monitoring, without fear that the authorities will communicate to third parties items of information whose disclosure could be damaging to them”. It is worth mentioning that Article 4 (3) of Regulation 1049/2001 does not protect “trust” between in itself. Furthermore, DG Home suggests that disclosure could prevent the grantee - in this case an EU Member State, Greece - from complying with its reporting obligations, which are non-negotiable. DG Home’s argument therefore relates to the implementation of the agreement, which, as it has already been established, is not a decision-making process per se, but a series of actions executed by a party (EU Member State Greece) with contractual obligations. In this sense. transparency - or lack of thereof - should not affect how an EU Member State executes the actions it has agreed to execute, or how the European Commission monitors and guarantees the actual implementation of its grant agreement, and the correct expenditure of EU funds which are meant to uphold the protection of fundamental rights in Europe. In this sense, yet again, the overriding public interest in disclosure becomes undeniable, as it is the only way scrutiny can be granted over which projects and actions the European Commission has agreed to support with public funds in its proclaimed quest to protect the fundamental rights of migrants and asylum-seekers arriving in EU soil. To this extent, I hereby call on the European Commission to disclose the requested documents in full.
