Commission assessment

Dear Directorate-General for Migration and Home Affairs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001 I am requesting the following documents:

-all documents, regarding the assessment carried out by the Commission pursuant to Art. 107(5) of the EBCG Regulation,

-as well as the proposal from the Commission pursuant to Art. 107(6) of the EBCG Regulation and all annexes, letters, e-mails, and any attachments linked to these documents, if applicable,

with regards to the director of European Border and Coast Guard Agency (Frontex) Fabrice Leggeri's extension of term of office and contract at the end of 2019.

Please also note that, in line with the European Ombudsman's decision in case 104/2020/EWM, we hereby express our wish to receive all responses and documents related to this request via this e-mail address only and not through the Frontex portal. We will not accept a notification to this e-mail address, but only the actual responses.

Dear European Commission, Please forward this to the person responsible for reviewing confirmatory applications. On 28 March 2022, we filed an access to documents request for all documents regarding the assessment carried out by the European Commission pursuant to Art. 107(5) of the EBCG Regulation, as well as documents regarding the proposal from the Commission pursuant to Art. 107(6) of the EBCG Regulation. Our initial request as well as all subsequent correspondence can be found here: https://fragdenstaat.de/anfrage/commi... On 16 May 2022, DG Home issued its response to our request. In its response, DG Home identified five documents falling within the scope of our application, out of which DG Home fully disclosed “Document 2” (the Proposal for a Commission decision on the extension of the term of office of the Executive Director of the European Border and Coast Guard Agency), and partially disclosed “Document 4” (Décisions administratives et budgétaires prises par la Commission lors de sa 2298ème réunion du mercredi 5 juin 2019, ref. Ares(2022)3468347) stating that the redacted parts of the documents did not fall under the scope of our request. As regards the remaining identified documents, DG Home granted partial access in application of the exception laid out in Article 4 (1)(b) of Regulation 1049/2001, protection of privacy and the integrity of the individual. Specifically, DG Home argued that: - Some parts of Document 1 contain information relating to an identified natural person, namely Mr Fabrice Leggeri, more specifically an assessment of the Executive Director’s performance and his capacity to address the Agency's future tasks and challenges; - Some parts of document 3 contain the names and other information relating to identifiable contact Commission staff members not pertaining to the senior management - Document 5 contains contact details and a handwritten signature To this regard, we argue that: 1. DG Home’s decision to grant partial access to Document 1 in application of Article 4(1)(b) of Regulation 1049/2001 and Article 9(1) of Regulation 2018/1725 is unlawful. DG Home’s response disregards that not all personal data is equally sensitive. As rightly pointed out by Advocate General Cruz Villalon, in certain situations, “the personal data are not, so to speak, the main object of the request for information, but the request relates instead to documents of a public nature that incidentally include information relating to individuals and, as such, contain ‘personal data’. Admittedly, the data are ‘personal’ in so far as they contain ‘information relating to an identified ... natural person’ [...], but this is prima facie ‘professional data’ and therefore less sensitive than information falling within the ambit of privacy or private life sensu stricto”. These situations, including the case at hand, require a more inclusive interpretation of the concept of ‘necessity’ under Article 9(1) point (b) of Regulation 2018/1725. (see Opinion of Advocate General Cruz Villalón delivered on 14 April 2015 in Case C-615/13 P ClientEarth and PAN Europe v EFSA, ECLI:EU:C:2015:219, para. 55.) It is undeniable that the requested documents contain not purely personal, but professional data as the documents are in themselves an evaluation of Mr. Leggeri’s professional qualifications, actions and capacities in his role as Executive Director of Frontex. To this extent, we argue that the disclosure of Document 1 in full is proportional on the basis of the existence of the overriding public interest in disclosure. It is crucial for us to recall that Fabrice Leggeri resigned from his position as Executive Director in April 2022. The Frontex Management Board thus concluded Mr. Leggeri’s employment on 28 April 2022. [1] This resignation followed multiple investigations in the media showing Frontex complicity in fundamental rights violations under Mr. Leggeri’s leadership. [2] Mr. Leggeri has been accused of holding direct responsibility for the failure to investigate and address with the agency these violations. [3] Subsequently, Frontex - as well as Mr. Leggeri’s role and extension of direct responsibility - have been under investigation by the European Parliament and the EU Anti-Fraud Office. [4] In addition to this, it must be underlined that among the reasons stipulated for his resignation, in his letter Mr. Leggeri stated that a divergence exists as to what was his core mandate: “it seems that Frontex mandate on which I have been elected and renewed in 2019 has silently but effectively been changed.” [5] The events cited above are directly and undoubtedly linked to the content of the requested documents, and specifically the content of Document 1 – the fact that Mr. Leggeri specifically mentions his 2019 renewal of mandate (which followed the Commission’s assessment) makes this evermore true. The document contains and elaborates the Commission’s own evaluation of Mr. Leggeri’s performance and his capacity to address the Agency's future tasks and challenges. This evaluation was in fact the basis for the approval of his mandate renewal. Given that Mr. Leggeri’s performance has in fact led to his own resignation, leaving behind an agency in deep crisis, under investigation, and whose staff is, according to the agency’s Deputy Director, “traumatised”, access to the requested documents, and particularly to Document 1, is of undeniable overriding public interest. [6] In light of all of the reasons above, we call on the European Commission to disclose Document 1 in full, following an overriding public interest.
