Danish patrol boat incident

Dear European Border and Coast Guard Agency,

On 6 July 2020, Frontex Director Fabrice Leggeri stated before the European Parliament’s LIBE Committee: "There was clearly apparently a misunderstanding of the operational plan."
This statement was made in reference to the incident involving a Danish patrol boat which reportedly refused to follow an order to push back migrants at sea.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:
All documents that served as a basis for obtaining the aforementioned conclusion, as expressed by Mr Leggeri. This includes, but is not limited to:
- All correspondence – including all attachments – regarding, mentioning or discussing the Danish patrol incident, and/or Frontex’s role in this incident;
- All relevant operational plans, including all annexes;
- All reports, evaluations, studies and analysis of any kind conducted by Frontex regarding or in response to the Danish patrol boat incident, and/or Frontex’s role in this incident;
- A list of all meetings held where the incident and/or Frontex’s role in this incident were discussed or mentioned, as well as all minutes of these meetings.

Please do not hesitate to contact me if you need any clarification in regards to any aspect of my request.
Please also note that, in line with the European Ombudsman's decision in case 104/2020/EWM, I hereby express my wish to receive all responses and documents related to this request via this e-mail address only and not through the Frontex portal. I will not accept a notification to this e-mail address, but only the actual responses.

In regards to your request for clarification of 26 August 2020, please note that in absence of a proper public register of Frontex documents in line with Article 11 of Regulation 1049/2001, it is essentially impossible for requesters to identify with a reasonable degree of precision which documents fall under the scope of any request. To this extent, I’d like to remind Frontex that the very purpose of a public register of documents is, as stated in the aforementioned article, to make “citizens' rights under this Regulation effective”. In this regard, Frontex must understand that I am only able to provide a timeframe for the documents falling under the scope of my request, as well as some examples of the documents I am interested in. I will note, however, that Frontex should be familiar by now with the concepts “correspondence” and “reports”. In regards to a timeframe, both for the requested correspondence and reports, I am interested in all documents produced or received by Frontex from 2 March 2020 to 6 July 2020, both included. Dear Frontex, Please note that my initial request was filed on 10 July 2020. The fact that it is taking Frontex almost three months to register a request is completely unacceptable. The subject of the present request (the Danish patrol boat incident) is well known to Frontex; the documents my request covers are well known to Frontex as well, since it routinely deals with similar scoped and phrased requests. Frontex must therefore register and start processing my request immediately, and stop delaying the process by asking for pointless clarifications. To this regard, in terms of the date of the incident, please note that this information is – unfortunately – not in the public domain, and I am therefore unable to provide it. However, given that the incident was covered by EU (https://www.politico.eu/article/danish-frontex-boat-refused-order-to-push-back-rescued-migrants-report/) and Danish (https://www.dr.dk/nyheder/indland/saadan-foregaar-bevogtningen-af-eus-yderste-graenser-dansk-patruljebaad-beordret-til) media, and that Frontex Executive Director Fabrice Leggeri has addressed this incident before the LIBE Committee (on 6 July 2020), I am absolutely certain that Frontex itself is able to identify the relevant date without my help. In terms of the scope, I will agree to limit “correspondence” to e-mails, letters, memos and phone logs, including all attachments. I will also limit the next point to: reports, evaluations and briefings. Finally, in terms of the search criteria, I believe my initial request – and subsequent clarifications – were clear enough. I am interested in documents (as per my initial request and further clarifications) mentioning or regarding the Danish patrol boat incident. It is not my role to explain Frontex how to conduct searches, especially since I am obviously not familiar with Frontex’s register of documents and archival systems. I would also like to point out that the lack of publicly available information around the Danish incident further makes Frontex’s request impossible. However, as I have stated before, the fact that Frontex routinely deals with similar phrased requests leads me to believe Frontex will be able to find, without my help, the relevant search terms to conduct documents searches in its own system.
