Dear Mr [geschwärzt], Europol has assessed your request and identified the following documents: The Terms of Reference 2 Briefing Notes A note on a follow-up technical session We regret to inform you that Europol has decided to refuse access to all of the documents on the basis of Article 4(1)(a) and (b) of the Management Board Decision laying down the rules for applying Regulation 1049/2001 with regard to Europol documents (the MB Decision on Public Access), as their disclosure would undermine the protection of the public interest as regards public security, such as the proper fulfilment of Europol’s tasks, investigations and operational activities of Member States, third parties and Union bodies, as well as the privacy and integrity of the individuals therein mentioned. These documents contain law enforcement sensitive and/or operational information, related among others to the workflow of the Terrorist Identification Task Force, methodologies of operational collaboration and challenges encountered, the disclosure of which would prevent Europol from supporting operational activities of the law enforcement authorities in their fight against terrorism. The disclosure of the information to the public would undermine Europol’s partners’ trust and endanger their mutual cooperation, which is essential to Europol’s activities, consequently hindering Europol’s ability to effectively perform its tasks. You may make a confirmatory application asking Europol to reconsider its position within 15 working days of receiving Europol’s reply, in accordance with Article 5(4) of the Management Board Decision.
