FRA role in Joint Pilot for the establishment of a new MPRIC in Lesvos

Dear Fundamental Rights Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

With regards to the involvement of the FRA in the development and implementation of the Joint Pilot for the establishment of a new Multi-Purpose Reception and Identification Centre in Lesvos [1]:

1. All studies, reports, evaluations, and assessments of any kind conducted by the FRA for the development and construction of the new MPRIC, i.e.: for the “Design and planning services for the new MPRIC and technical teams to support creation according to EU standards and EU best practice model (architects, etc.), including based on lessons learned via the previous Safety and Security Working Group (SSWG)”

2. All documentation (including - but not limited to – reports, notes from field visits, legal basis, legal analysis or guidelines) used by the FRA in order or as a basis to produce the aforementioned studies.

I am also requesting:

3. All documents regarding the “Design of a dedicated facility (Safe Zone) for Unaccompanied Minors”. This may include – but not limited to – any reports, evaluations, guidelines, recommendations, and any draft produced to date for this purpose.

4. All documents regarding, proposing or approving the procedure for the appointment of a UAM focal point(s) “that would be in charge of all UAM-related actions” at the new MPRIC.

And finally:

5. For any and all meetings held or attended by the FRA to discuss or regarding the Greek MPRIC::

- all agendas for each of these meetings;
- any record of the aforementioned meetings. This may include, but not necessarily limited to, minutes of the meetings, verbatim reports of the meetings, transcripts etc, that would provide a record of the proceedings of the meetings; and
- all documents prepared or received by the FRA for the purpose of these meetings and/or distributed among the attendees before or during the course of these meetings (such as – but not limited to – handouts, leaflets, briefings or background notes).

Dear Fundamental Rights Agency, Please pass this on to the person reviewing confirmatory applications. On 29 March 2021 I filed an access to documents request regarding the FRA’s involvement in the development and implementation of the Joint Pilot for the establishment of a new Multi-Purpose Reception and Identification Centre in Lesvos. My request - as well as all subsequent correspondence - can be found here: https://fragdenstaat.de/en/request/fr... My request was acknowledged on 7 April 2021, and awarded reference number MIncoming-2021-125. On 21 May 2021 I received the FRA’s response to my request, in which the agency: granted full disclosure to a series of documents; granted partial disclosure to a series of documents by application of the exceptions laid out in Article 4 (1)(b) and 4 (1)(a) of Regulation 1049/2001; and fully refused access to a series of documents by application of the exceptions in Article 4 (3), 4 (2)(1), 4 (1)(a) and 4 (5) of Regulation 1049/2001. To this extent, I hereby argue that, for the following documents, the FRA’s partial or total refusal is unlawful, contravenes established EU case law, and therefore should be released in full. - Document 14a In its response, FRA grants partial access to this document by application of Article 4 (1)(a) of Regulation 1049/2001, merely stating that “disclosure would undermine the public interest and financial policy of a Member State”. It must be recalled that, according to well-established case law, EU authorities must demonstrate how disclosure would “specifically and actually” undermine an interest protected under Article 4 of Regulation 1049/2001. Authorities must also demonstrate how this risk is “reasonably foreseeable and not purely hypothetical”. In its response, the FRA provides no justification whatsoever as to how disclosure would undermine “a Member State”’s “financial policy”; it also does not offer proof of how this assertion is not merely hypothetical. In fact, the FRA’s justification is so vague not even the allegedly-affected Member State is identified. The FRA’s failure to provide even the slightest proof of how disclosure would specifically and actually undermine “a Member State”’s financial policy contravenes EU case law. In absence of proper justification for this partial refusal, the document must be disclosed in full. - Documents 2, 4, 6, 9, 10, 11a, 16, 18, 19, 23, 24, 25, 27, 28, 32, 34, 38, 39, 42, 47, 50, 51, 53, and 55 In its response, the FRA refuses access to these documents in full by application of the exception laid our in Article 4 (3) of Regulation 1049/2001, protection of the decision-making process. To this regard, the FRA states: “the documents contain opinions for internal use and are part of deliberations and preliminary consultations.” The FRA also states: “The FRA must be free to explore all possible options in preparation of a decision free from external pressure.” Here again, the FRA has failed to provide an explanation as to how disclosure would seriously undermine its decision-making process - as required by Regulation 1049/2001 itself, as well as the above-cited, well-established case law. The FRA has also failed to demonstrate how the risk posed by disclosure would be “reasonably foreseeable and not purely hypothetical”. The FRA has merely argued that it must be free to explore options free from external pressure upon preparation of a decision. This, however, does not constitute an explanation in itself as to how disclosure in this particular case would in fact prevent the FRA from carrying out internal deliberations in the future. According to the FRA, the agency’s key mandate is to promote and protect fundamental rights in the EU, including by providing “independent, evidence-based advice on rights”; “[helping] better law making and implementation”; and “[supporting] rights-compliant policy responses”. To this extent, it is hard to believe that disclosure of the requested documents would in the future prevent the FRA from exercising its mandate, including the provision of advice and support on rights-related matters. The implication that the FRA would be more or less inclined to protect and promote fundamental rights in the EU depending on the amount of “external pressure” it receives, is one that, I am sure, the FRA would refute itself. Furthermore, it is worth noting that the Court of Justice has established that, for external pressure to constitute legitimate ground for refusing access to requested documents, the reality of such external pressure must be established with certainty, and evidence must be provided to show that there is a foreseeable risk that the decision to be taken would be substantially affected due to this external pressure. To this extent, the narrow arguments put forward by the FRA lack of the certainty and evidence required by the court. Additionally, it is worth mentioning that, if by “external pressure” the FRA is referring to the ability of members of the public to express their opinion about a given subject, decision-making process or court proceeding, then this external influence can better be defined as citizens’ exercise of their right of freedom of expression and their right to participate in the EU democratic process. I would like to recall that one of the essential pillars on the basis of which the EU was founded is a participatory democracy. To this extent, “external pressure” cannot in any way be considered grounds on which access to the requested documents can be refused, but only an incentive for greater transparency. This should be most evident and valuable to the FRA, above any other EU body. Finally, I would like to argue that there is indeed an overriding public interest in the disclosure of the requested documents. The Joint Pilot these documents relate to pertains to the area of migration, and more specifically to reception centres meant to host asylum-seekers in the Greek islands, therefore entailing an important series of considerations regarding the protection of fundamental rights and compliance with international law in European soil. It must be recalled that these reception centres will be built in order to address the failures of previous reception centres such as the Moria camp in Lesvos, now entirely destroyed due to a fire. The EU institutions - including the EU Commission, who has in fact provided public EU funds for the construction of these sites - have repeatedly stated that the EU will provide adequate, human rights-compliant reception conditions in the future, and that it will be transparent about it. This means that the overriding public interest in the disclosure of these documents is undeniable - and that transparency from the FRA in particular is of upmost importance. - Documents 15 and 54 In its response, the FRA refuses access to these documents in full by application of Article 4 (2)(1) of Regulation 1049/2001, merely stating that disclosure “would undermine the protection of commercial interests of a legal person”. Yet again, the FRA’s response fails to comply with EU case law requiring EU authorities to demonstrate how disclosure would “specifically and actually” undermine an interest protected under Article 4 of Regulation 1049/2001; and to demonstrate how this risk is “reasonably foreseeable and not purely hypothetical”. In its response, the FRA provides no explanations or arguments: the commercial interests are not identified, nor is the “legal person” whose interests are being protected. FRA’s response is therefore very far from satisfying the court’s demands to provide specific and proper justifications upon refusing access to an EU document. Having failed to comply with these obligations, the FRA should release the requested documents in full. - Document 13d In its response, FRA grants partial access to this document by application of Article 4 (1)(a) of Regulation 1049/2001, stating that “disclosure would undermine the European Union’s Institutions financial policy”. As in the case of documents 14a, 15 and 54, the FRA’s response fully fails to comply with its already-established and cited obligations. For the reasons cited in the arguments already exposed in this confirmatory application, failure to comply with established case law must result in full disclosure of the requested document. - Documents 31 and 44 In its response, the FRA states that “disclosure is prevented by the exception laid down in Article 4(5) which requires the Member States agreement.” To this extent, it must be stated that what Article 5 of Regulation 1049/2001 states is: “A Member State may request the institution not to disclose a document originating from that Member State without its prior agreement.” In this sense, disclosure does not in fact require a Member State’s agreement. While a Member State may indeed request a document is not disclosed, the ultimate decision lies with the EU authority, and in the present case, the FRA. While in its response the FRA does not clarify whether there was a request on behalf of a Member State not to disclose the requested documents, it must be recalled that even if this were the case, the Member State should have explained how and why the requested documents are covered by one of the exceptions laid out in Article 4 of Regulation 1049/2001. Nothing in the FRA’s response suggests this explanation has taken place Furthermore, it must be recalled that according to the EU court, Member States do not have a right of veto over disclosure. The FRA’s assertion that disclosure “requires the Member States agreement” is therefore incorrect - the decision to disclose a document or not ultimately lies with the FRA. To this extent, and given that no other explanation or justification is provided to substantiate the refusal of the requested documents on the basis of the exceptions in Article 4 of Regulation 1049/2001, the documents must be disclosed in full. To this extent, in light of the arguments exposed above, I hereby call on the FRA to act in full compliance with EU law and EU case law by disclosing documents 14a, 2, 4, 6, 9, 10, 11a, 16, 18, 19, 23, 24, 25, 27, 28, 32, 34, 38, 39, 42, 47, 50, 51, 53, 55, 15, 54, 13d, 31 and 44.
