Es ist mir bereits mehrmals passiert, dass ich mit meinem Fahrrad bei Bahnreisen im Fernverkehr irgendwo in der Republik gestrandet bin. Grund dafür war in der Regel ein ausgefallener Fernverkehrszug und belegte Fahrradstellplätze in den nachfolgenden Fernverkehrszügen.

1. Ich bitte Sie daher um eine Handlungsempfehlung für die Weiterreise mit dem Fahrrad für das beschriebene Szenario.

2. Wie viel Prozent der Fahrradstellplätze können gebucht werden? Werden Stellplätze für ausfallende Züge freigehalten?

3. Wann wird es möglich sein, online ein Bahnticket inklusive Fahrradstellplatz für internationale Fahrten buchen können?

Es ist mir bereits mehrmals passiert, dass ich mit meinem Fahrrad bei Bahnreisen im Fernverkehr irgendwo in der Republik gestrandet bin. Grund dafür war in der Regel ein ausgefallener Fernverkehrszug und belegte Fahrradstellplätze in den nachfolgenden Fernverkehrszügen. 

Ich bitte Sie daher um eine Handlungsempfehlung für die Weiterreise mit dem Fahrrad für das beschriebene Szenario. 

Wie viel Prozent der Fahrradstellplätze können gebucht werden? Werden Stellplätze für ausfallende Züge freigehalten? 

Wann wird es möglich sein, online ein Bahnticket inklusive Fahrradstellplatz für internationale Fahrten buchen können?

Dies ist ein Antrag auf Zugang zu amtlichen Informationen nach § 1 des Gesetzes zur Regelung des Zugangs zu Informationen des Bundes (IFG) sowie § 3 Umweltinformationsgesetz (UIG), soweit Umweltinformationen im Sinne des § 2 Abs. 3 UIG betroffen sind, sowie § 1 des Gesetzes zur Verbesserung der gesundheitsbezogenen Verbraucherinformation (VIG), soweit Informationen im Sinne des § 1 Abs. 1 VIG betroffen sind. Sollte der Informationszugang Ihres Erachtens gebührenpflichtig sein, möchte ich Sie bitten, mir dies vorab mitzuteilen und detailliert die zu erwartenden Kosten aufzuschlüsseln. Meines Erachtens handelt es sich um eine einfache Auskunft. Gebühren fallen somit nach § 10 IFG bzw. den anderen Vorschriften nicht an. Auslagen dürfen nach BVerwG 7 C 6.15 nicht berechnet werden. Sollten Sie Gebühren veranschlagen wollen, bitte ich gemäß § 2 IFGGebV um Befreiung oder hilfsweise Ermäßigung der Gebühren. Ich verweise auf § 7 Abs. 5 IFG/§ 3 Abs. 3 Satz 2 Nr. 1 UIG/§ 4 Abs. 2 VIG und bitte Sie, mir die erbetenen Informationen so schnell wie möglich, spätestens nach Ablauf eines Monats zugänglich zu machen. Kann diese Frist nicht eingehalten werden, müssen Sie mich darüber innerhalb der Frist informieren. Ich bitte Sie um eine Antwort per E-Mail gemäß § 1 Abs. 2 IFG. Ich widerspreche ausdrücklich der Weitergabe meiner Daten an behördenexterne Dritte. Sollten Sie meinen Antrag ablehnen wollen, bitte ich um Mitteilung der Dokumententitel und eine ausführliche Begründung. August 2022, uns zugegangen am selben Tag, mit der Sie folgendes Informationsersuchen an uns gerichtet haben: „Bahnreisen im Fernverkehr mit Ihrem Fahrrad“ Wir müssen Ihnen leider mitteilen, dass die Deutsche Bahn keine auskunftspflichtige Stelle nach dem IFG ist. Ein Auskunftsanspruch nach dem IFG besteht allein gegenüber der zuständigen Behörde des Bundes. § 1 Abs. 1 IFG lautet: Jeder hat nach Maßgabe dieses Gesetzes gegenüber den Behörden des Bundes einen Anspruch auf Zugang zu amtlichen Informationen. Für sonstige Bundesorgane und -einrichtungen gilt dieses Gesetz, soweit sie öffentlich-rechtliche Verwaltungsaufgaben wahrnehmen. Einer Behörde im Sinne dieser Vorschrift steht eine natürliche Person oder juristische Person des Privatrechts gleich, soweit eine Behörde sich dieser Person zur Erfüllung ihrer öffentlich-rechtlichen Aufgaben bedient. Auch ein Anspruch nach dem UIG bzw. dem VIG besteht nicht, da weder Zugang zu Umweltinformationen nach dem UIG noch zu Informationen nach dem VIG begehrt wird. Die Bahn ist auch keine auskunftspflichtige Stelle nach dem VIG. Der Auskunftsanspruch richtet sich allein gegen die zuständige Behörde des Bundes bzw. des Landes. § 2 Abs. 3 UIG lautet: Umweltinformationen sind unabhängig von der Art ihrer Speicherung alle Daten über 1. den Zustand von Umweltbestandteilen wie Luft und Atmosphäre, Wasser, Boden, Landschaft und natürliche Lebensräume einschließlich Feuchtgebiete, Küsten- und Meeresgebiete, die Artenvielfalt und ihre Bestandteile, einschließlich gentechnisch veränderter Organismen, sowie die Wechselwirkungen zwischen diesen Bestandteilen; 1. Faktoren wie Stoffe, Energie, Lärm und Strahlung, Abfälle aller Art sowie Emissionen, Ableitungen und sonstige Freisetzungen von Stoffen in die Umwelt, die sich auf die Umweltbestandteile im Sinne der Nummer 1 auswirken oder wahrscheinlich auswirken; 1. Maßnahmen oder Tätigkeiten, die a) sich auf die Umweltbestandteile im Sinne der Nummer 1 oder auf Faktoren im Sinne der Nummer 2 auswirken oder wahrscheinlich auswirken oder b) den Schutz von Umweltbestandteilen im Sinne der Nummer 1 bezwecken; zu den Maßnahmen gehören auch politische Konzepte, Rechts- und Verwaltungsvorschriften, Abkommen, Umweltvereinbarungen, Pläne und Programme; 1. Berichte über die Umsetzung des Umweltrechts; 1. Kosten-Nutzen-Analysen oder sonstige wirtschaftliche Analysen und Annahmen, die zur Vorbereitung oder Durchführung von Maßnahmen oder Tätigkeiten im Sinne der Nummer 3 verwendet werden, und 1. den Zustand der menschlichen Gesundheit und Sicherheit, die Lebensbedingungen des Menschen sowie Kulturstätten und Bauwerke, soweit sie jeweils vom Zustand der Umweltbestandteile im Sinne der Nummer 1 oder von Faktoren, Maßnahmen oder Tätigkeiten im Sinne der Nummern 2 und 3 betroffen sind oder sein können; hierzu gehört auch die Kontamination der Lebensmittelkette. § 1 VIG lautet: Durch dieses Gesetz erhalten Verbraucherinnen und Verbraucher freien Zugang zu den bei informationspflichtigen Stellen vorliegenden Informationen über 1. Erzeugnisse im Sinne des Lebensmittel- und Futtermittelgesetzbuches (Erzeugnisse) sowie 1. Verbraucherprodukte, die dem § 2 Nummer 26 des Produktsicherheitsgesetzes unterfallen (Verbraucherprodukte).
