Dear European Border and Coast Guard Agency,
Based on Regulation (EC) No 1367/2006 and Regulation (EC) No 1049/2001, I request all documents regarding an incident on 10.08.2020 close to Samos (Mentioned in this article: https://www.rnd.de/politik/bericht-inne…).

This includes, but is not limited to:
- All correspondence – including all attachments – regarding, mentioning or discussing the incident, and/or Frontex’s role in this incident;
- All relevant operational plans, including all annexes;
- All reports, evaluations, studies and analysis of any kind conducted by Frontex regarding or in response to the incident, and/or Frontex’s role in this incident;
- A list of all meetings held where the incident and/or Frontex’s role in this incident were discussed or mentioned, as well as all minutes of these meetings.

Frontex Transparency Office, Thank you for your quick response. You asked me to specify my request in your last message. In general I think the the request is specific enough since the incident is clearly specified. A very similar request requesting the same kind of information (PAD-2020-00123) was eventually answered by the transparency office. Nevertheless, I'll try to give answers to the three reasons you supplied. "1. we cannot accept links to the Third-Party websites" I assume you're referring to the article mentioned in the initial message. I'm not sure why it's not possible for you to open third party websites, however I'll quote the relevant section of that article for you: "Wie laut “Spiegel” aus Dokumenten von Frontex hervorgeht, seien dieselben Flüchtlinge nur wenig später in türkischen Gewässern wieder aufgetaucht. Das belegten Fotos. Die Menschen seien offensichtlich von den griechischen Grenzschützern illegal zurückgedrängt worden, heißt es weiter." The article mentions Frontex documents concerning this incident. "2. please specify what you mean by "this includes, but is not limited to" Since there is no public register of documents, or even types of documents that are available, I have to use this broad term. If there are any types of documents similar to the ones mentioned in the initial request but don't match the mentioned document type exactly, I'd still like to request them. If you are willing to provide a register of available document types, I'll be open to provide further specification. "3. the first indent “All correspondence – including all attachments – regarding, mentioning or discussing the incident, and/or Frontex’s role in this incident” is not precise enough to enable us to conduct an effective search for documents." I assume what you are asking here is to specify the term 'correspondence'. This means all internal communication regarding the incident, aswell as communication with external entities regarding the incident. I'm using this broad term, because I don't know the types of communication used at Frontex. Generally this includes (for example): e-mails, letters, fax-messages, memos and phone logs, including all attachments. I hope that I was able to remove ambiguity. Dear Frontex Transparency Office, Thank you for your reply. In response to your decision to refuse access to all requested documents, I would like to submit a confirmatory application. Access to documents in regard to indents 1, 3 and 4 was refused because they contain personal data, refer to details of the operational area, contain details on the means of communication used by law enforcement officials and contain information regarding technical equipment deployed in the operational area. On the assumption that this is not the only information contained in these documents, a partial release should be performed, in accordance with Article 4.6 of Regulation 1049/2001. You state, that a partial release of any of these documents is prevented because all these documents pertain to ongoing investigations. However, no reason is given in what way disclosure of a document or of certain redacted parts thereof would specifically and effectively undermine the protection of the purpose of an ongoing investigation. This should be explained for all documents, as stated by the Ombudsman in their comment for decision 1616/2016/MDC. There is also no reasonable explanation given on why this justifies not releasing the documents at all instead of releasing them partially. Access to documents in regard to indent 2 was refused, with the provided reason being that granting access to these documents would hamper the evaluation of the mission. Operational plans, including operational plans for Joint Operation Poseidon with all Annexes were released in the past in response to information requests.
