There must be transparency balanced with protecting sensitive information, that information being operational data in Frontex joint operations. The ruling confirms Frontex achieved that balance. [Opinion] PROPOSED PRESS RELEASE General Court Judgment in Case Izuzquiza and Semsrott v Frontex (Case T-31/18) The General Court (Court of Justice of the European Union) was asked to adjudicate on whether Frontex’s refusal to release sensitive documents (under the public access to documents framework) containing information on the name, type and flag of EU Member States’ vessels would have undermined the protection of the public interest as regards public security as laid down in Article 4(1)(a) first indent of Regulation (EC) No 1049/2001. In its judgment delivered today, the Court confirms - preceded by the European Ombudsman decision in a similar case regarding Poseidon and Triton operations - Frontex’s practice regarding public access to documents. Frontex welcomes this endorsement of its efforts. Frontex will continue developing its processes to ensure the adherence to the legal framework in light of a significant increase of applications.
