In your request you seek access to a) Correspondence - including, but not limited to, letters, e-mails, and any attachments b) Documents - including, but not limited to, evaluations, descriptions, briefing, notes, reports, analysis, presentations, list of participants concerning meetings with the representatives of the Airbus Group since 2017 As the description given and the range of documents requested in your application is very broad, we invite you, in accordance with Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents, to provide us with more detailed information on the type of documents you request, such as references, topic or subject matter of the documents requested, specific dates or periods during which the documents would have been drawn up, specific persons who participated in drafting the documents/correspondence you seek access to etc. If you need assistance in clarifying or specifying your application, you can contact us by email to: <<E-Mail-Adresse>><mailto:<<E-Mail-Adresse>>> . Dear Madam, Thank you for your reply to our email of 11 March 2022 asking to clarify and narrow down the scope of your four parallel requests for access to documents, all registered on 07 March 2022. We invited you to clarify your applications, in accordance with Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents, notably to provide us with more detailed information on the type of documents you request, such as references, topic or subject matter of the documents requested, specific dates or periods during which the documents would have been drawn up, specific persons who participated in drafting the documents/correspondence you seek access to etc. We furthermore invited you to limit the time span of your application so as to reduce it to a more manageable number of documents in order to allow EDA to perform a more targeted and time efficient search for relevant documents. Without clarifying or limiting the scope of your initial requests, you propose that EDA sends you a full list of all meetings since 2017 including the date as well as the purpose of the meetings, in order to allow you to select the meetings that you are interested in on this basis. Unfortunately, your proposal would require the creation of a document entailing a disproportionate administrative burden for the Agency and would, in any event, go beyond the requirements of the Regulation. In order to conduct a more targeted search corresponding to your interests we would still like to find a fair solution pursuant to Article 6(3) of Regulation (EC) No 1049/2001 with regards to the scope of your request. In view of finding a fair solution, from our side, we would therefore like to propose to you a limitation of your applications to documents concerning meetings involving from EDA side the Chief Executive and/or Deputy Chief Executive as of 2019. Your four parallel applications concern a very large number of document(s), which need to be assessed individually. Such a detailed analysis cannot be carried out within the normal time limits set out in Article 7 of Regulation 1049/2001. The analysis of these document(s), together with the need to consult the third parties concerned in accordance with Article 4(4) and 4(5) of Regulation 1049/2001, cannot reasonably be completed within the normal time limits set out in Article 7(1) of Regulation 1049/2001. We are thus making use of the possibility to extend the deadline to 30 working days pursuant to Article 7(3) of Regulation 1049/2001 which will end on 21 April 2021, counting from the registration of your application on 07 March 2022. We invite you to provide us with your feedback to our proposal for limiting the scope within 4 working days, by Friday, 25 March 2022 at the latest, in order to allow us to process your applications. Dear Madam, I refer to our email of 21/03/2022 below, as we have not received any feedback on our proposal to address your four parallel requests for access to documents, registered on 07/03/2022. As a reminder, on 11/03/2022 we sent you an email requesting a clarification and narrowing of the scope of your request in order to conduct a more targeted search corresponding to your interests, in view of finding a fair solution pursuant to Article 6(3) of Regulation (EC) No 1049/2001. On 17/03/2022, you responded with an alternative proposal which we carefully considered. However, as explained to you in an email dated 21/03/2022, we informed you that your alternative proposal would require the creation of a document entailing a disproportionate administrative burden for the Agency and going beyond the requirements of the Regulation. In the same email of 21/03/2022, we made yet another proposal to reach a fair solution to meet your interests and proposed to process your applications with a scope of documents concerning meetings involving from EDA side the Chief Executive and/or Deputy Chief Executive as of 2019. Dear Sir or Madam, thank you for the reminder. Unfortunately, I was not able to respond in the time frame set by you due to personal reasons. I would therefore ask for your understanding and would answer the following to your proposal of the 21st of March to a limitation "to documents concerning meetings involving from EDA side the Chief Executive and/or Deputy Chief Executive as of 2019". I would not agree with this proposal and will hold on to my initial request to first create a list with all the meetings and later to select the ones that I am interested in the most. Dear Madam, I refer to your latest reply of 01/04/2022, communicating your disagreement with regards to the fair solution proposed by EDA and reiterating your request for EDA to create a list of all meetings in order to allow you to select the ones you are interested in. Firstly, I would like to point out that EDA is under no obligation to create new documents, such as drawing up the complete list of all meetings to be provided to you for further selection. The right of access to documents applies only to existing documents in the possession of the institution concerned. Regulation (EC) 1049/2001 may not be relied upon to oblige an institution to create a document which does not exist, as confirmed by the Court of Justice (cf. Judgment of 11 January 2017, Typke v Commission, C-491/15 P, ECLI:EU:C:2017:5, paragraph 31). Furthermore, in reply to your suggestion regarding timing, I would like to clarify that EDA is indeed bound by the strict time limits stipulated by Article 7 of Regulation (EC) 1049/2001. In order to meet our obligations under the Regulation, we have now already initiated the search of relevant documents on the basis of the redefined scope (documents concerning meetings involving from EDA side the Chief Executive and/or Deputy Chief Executive as of 2019), as confirmed in our email of 31/03/2022. On this basis, I will revert to you in due course, within 30 working days counting from the date of registration of your initial application. Reply of Mr Jiří Šedivý, Chief Executive of EDA to Airbus - dated 30 September 2021 (personal data redacted) Please note that a full disclosure of some of the identified documents (marked as redacted) is prevented by the exception concerning the protection of privacy and the integrity of the individual outlined in Article 4(1)(b) of Regulation (EC) No 1049/2001, because they contain personal data. Article 9(1)(b) of Regulation No 2018/1725 does not allow the transmission of these personal data, except if you prove that it is necessary to have the data transmitted to you for a specific purpose in the public interest and where there is no reason to assume that the legitimate interests of the data subject might be prejudiced. In your request, you do not put forward any arguments to establish the necessity to have the data transmitted for a specific purpose in the public interest. Consequently, we have concluded that, pursuant to Article 4(1)(b) of Regulation 1049/2001, access cannot be granted to the personal data contained in the requested documents, as the need to obtain access thereto for a purpose in the public interest has not been substantiated and there is no reason to think that the legitimate interests of the individuals concerned would not be prejudiced by disclosure of the personal data concerned. Please also be informed that we have identified further documents that correspond to the criteria given in your request and which relate to internal documents re. (1) internal briefing notes for the Chief executive(s) of EDA, (2) procurement related documents and (3) internal meeting reports. Having examined the documents requested under the provisions of Regulation 1049/2001 regarding public access to documents, we regret to inform you that access to those documents cannot be granted, as disclosure is prevented by exceptions to the right of access laid down in Article 4 of this Regulation. First, please note that only some parts of those documents fall under the scope of your request as only part of the document(s) relates to Airbus. Second, the parts of the documents identified that do correspond to the criteria given in your request are protected by the following exceptions: 1. Art. 4(1)(a) second indent - defence and military matters. The documents contain information regarding projects relating to defence and military matters. Additionally, some of the projects mentioned are still ongoing. 1. Art. 4(2) first indent - commercial interests of a natural or legal person, including intellectual property. The documents, notably the procurement related ones, contain information of commercial nature the disclosure of which could undermine and impact negatively the business activities and commercial interests of Airbus. 1. Art. 4(1)(b) privacy and the integrity of the individual, in particular in accordance with Union legislation regarding the protection of personal data. Article 9(1)(b) of the Data Protection Regulation does not allow the transmission of these personal data, except if you prove that it is necessary to have the data transmitted to you for a specific purpose in the public interest and where there is no reason to assume that the legitimate interests of the data subject might be prejudiced. We have considered whether partial access could be granted to the documents requested. Unfortunately, even in such a case the interests protected under Article 4 would be prejudiced. Therefore, access to the entirety of the documents must be refused. Means of redress In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a confirmatory application requesting EDA to review its position. Firstly, I would like to point out that EDA is under no obligation to create new documents, such as drawing up the complete list of all meetings to be provided to you for further selection. The right of access to documents applies only to existing documents in the possession of the institution concerned. Regulation (EC) 1049/2001 may not be relied upon to oblige an institution to create a document which does not exist, as confirmed by the Court of Justice (cf. Judgment of 11 January 2017, Typke v Commission, C-491/15 P, ECLI:EU:C:2017:5, paragraph 31). Furthermore, in reply to your suggestion regarding timing, I would like to clarify that EDA is indeed bound by the strict time limits stipulated by Article 7 of Regulation (EC) 1049/2001. In order to meet our obligations under the Regulation, we have now already initiated the search of relevant documents on the basis of the redefined scope (documents concerning meetings involving from EDA side the Chief Executive and/or Deputy Chief Executive as of 2019), as confirmed in our email of 31/03/2022. On this basis, I will revert to you in due course, within 30 working days counting from the date of registration of your initial application.
