By your application under the reference number *GestDem** 2022/1352*, you are requesting: *- Correspondence - including, but not limited to, letters, e-mails, and any attachments- Documents – including, but not limited to, evaluations, descriptions, briefing, notes, reports, analysis, presentations, list of participants* *concerning meetings with the representatives of the company Thales since 2017.* By your application under the reference number *GestDem** 2022/1359*, you are requesting: *- Correspondence - including, but not limited to, letters, e-mails, and any attachments- Documents – including, but not limited to, evaluations, descriptions, briefing, notes, reports, analysis, presentations, list of participants* *concerning meetings with representatives of the company Indra since 2017.* By your application under the reference number *GestDem** 2022/1391*, you are requesting: *- Correspondence - including, but not limited to, letters, e-mails, and any attachments- Documents – including, but not limited to, evaluations, descriptions, briefing, notes, reports, analysis, presentations, list of participants* *concerning meetings with representatives of the company Leonardo since 2017. * The circumstances of the introduction of your requests, their timing, their scope, as well as their wording give us the impression that a very wide-scoped request is split in parts and introduced as seemingly separate requests. In this respect, the General Court confirmed in its Ryanair judgment (Judgment of the General Court of 10 December 2010, Ryanair v Commission, T- 494/08,EU:T:2010:511,paragraph 34) that Article 6(3) may not be evaded by splitting an application into several, seemingly separate, parts. As stated by the EU Courts, the European Commission needs to respect the principle of proportionality and ensure that the interest of the applicant for access is balanced against the workload resulting from the processing of the application for access in order to safeguard the interests of good administration. Similarly to the above-mentioned cases underlying the case-law of the EU Courts on wide-scoped requests, DG CONNECT cannot, in this case, accept an artificial splitting of a wide-scoped request into simultaneous, seemingly separate individual applications, as this would result in a circumvention of Article 6(3) of Regulation 1049/2001, and the need for DG CONNECT to ensure that to balance the interest in public access to the documents against the burden of work so caused, in order to safeguard the interests of good administration(Judgment of the Court of First Instance of 13 April 2005, Verein für Konsumenteninformation v Commission, T-2/03, EU:T:2005:125, paragraph 102). Your applications concern a very large number of documents. Please note that at this stage, according to our estimate more than 565 documents would fall within the scope of the requests, in particular: -approximately 465 documents would fall within the scope of the request *GestDem** 2022/1352* -approximately 25 documents would fall within the scope of the request *GestDem** 2022/1359* -approximately 75 documents would fall within the scope of the request *GestDem** 2022/1391*. Due to the scope of your wide scoped request, its handling would involve the entire DG CONNECT, the former and current Commissioners and their Cabinets and would entail the following steps: -          multiple searches for the identification of the documents which may fall within the scope of the request and consultations within DG CONNECT, with the Cabinet and the archives service; -          retrieval, individual analysis of the documents  and establishment of a complete list of the documents falling under the scope of your request; -          scanning of the documents which are not in pdf format; -          preliminary individual assessment of the content of the documents in light of the exceptions contained in Article 4 of Regulation 1049/2001; -          assessment of the further procedural steps to undertake, for example whether third party consultations should be made; -          for many of the documents, third party consultations under Article 4(4) and/or 4(5) of Regulation 1049/2001; -          final assessment of the documents in light of the comments received; -          redaction of those parts of the documents to which one or several exceptions apply; -          preparation and finalisation of the reply for the request, and -          preparation of the reply and the documents for dispatch. It follows from the above that the work needed for the treatment of your request cannot expected to be completed within the normal time limits set out in Article 7 of Regulation 1049/2001. Article 6(3) of the Regulation 1049/2001 provides that, in the event of an application relating to a very long or a very large number of documents, the institution concerned may confer with the applicant informally with a view to finding a fair solution. In accordance with the case law of the Union Courts, the proposal for a fair solution aims to balance the interest of the applicant against the workload resulting from the processing of the application in order to safeguard the interests of good administration (Judgments of 6 December 2001, Council v Hautala, Case C 353/99 P, EU:C:2001: 661, para. 30, and of 2 October 2014, Strack v Commission, Case C 127/13 P, EU:C:2014:2250, para.27). Such solution can only concern the content or the number of documents applied for, not the deadline for replying (Judgment of the Court of Justice of 2 October 2014 in case C- 127/13, Guido Strack v Commission, paragraphs 26-28). This means that the scope of the request must be reduced in a way that would enable its treatment within the extended deadline of 15 + 15 working days. Taking this into account and based on the above-mentioned provision, we would kindly ask you to specify the objective of your request, your specific interest in the requested documents and whether you could narrow down the scope of your request, so as to reduce it to a more manageable amount of documents. In order to help you narrow down the scope of your request please note that we have identified **policy related meetings** and **project related meetings** with representatives of the abovementioned entities (including their subsidiaries). With regard to the **policy related meetings** at this stage we have identified **approximately 35 documents** falling within the following main categories of documents: - Briefings -Minutes/Back to Office (BTO) Reports -Email exchanges/ Letters, including correspondence relating to meetings/conferences invitations, meeting arrangements and agendas Please note that some of the email exchanges may contain attachments which need to be assessed individually. For your convenience, please find below the meetings between the DG CONNECT Director-General, the Commissioners for DG CONNECT/ members of their Cabinet and the representatives of the three companies, which were retrieved from the Transparency Register ( https://ec.europa.eu/info/about-europ... ) and which we consider relevant to your requests: *GestDem** 2022/1352*: -          Meeting with Roberto Viola (Director General of Communications, Networks, Content and Technology -CONNECT) on 26 May 2020 in Brussels, with the subject ‘Telesat LEO constellation project’. *GestDem** 2022/1359*:** -          Videoconference with Thierry Breton (Commissioner) and Fabrice Comptour (Cabinet member of Thierry Breton) on 7 May 2021 with the subject ‘Cloud & Data Alliance – CEO Roundtable’. -          Videoconference with Fabrice Comptour (Cabinet member of Thierry Breton) and Thierry Breton (Commissioner) on 16 December 2020 with the subject  ‘Roundtable - Cloud Alliance’. *GestDem** 2022/1391*: -          Videoconference with Fabrice Comptour (Cabinet member of Thierry Breton), Thierry Breton (Commissioner) and Valere Moutarlier (Cabinet member of Thierry Breton) on 14 December 2021 with the subject  ‘EU Data strategy, European Cloud Alliance’. With regard to **project related exchanges** please note the following: The abovementioned entities have participated in various projects as project Coordinator or partners/ consortium members. At this stage the projects identified cover a range of areas and have been managed by the following DG CONNECT Directorates: Directorate A (Digital Industry) Directorate C (Digital Excellence and Science infrastructure) Directorate H (Digital Society, Trust and Cybersecurity) At this stage we have identified approximately 530 project related documents, falling within the following main categories: - E-Mails/ Letters, including correspondence relating to meeting invitations, arrangements, agendas - Deliverables - Review reports Please note that some of the email exchanges may contain attachments which need to be assessed individually. Taking into account the other ‘access to documents’ requests being handled within DG CONNECT at the same time, including the other access to documents request that you have submitted (GestDem 2022/1607), the global workload of the concerned staff during the same period, the human resources available and the need to safeguard good administration, we consider that in the remaining timeframe we would be able to deal with in total a maximum of 15 documents  falling within your combined wide scoped request. For the selection of the documents to be dealt with, it would be helpful if you could indicate whether your preference is related to policy or to project related documents and to be as specific as possible taking into account the information we have provided above. In order to enable us to respect the time limits of Regulation 1049/2001, we would ask you for a swift response to our proposal for a fair solution.
