Dear Mr. Antragsteller/in Antragsteller/in, Once again thank you for your interest in EMSA activities. Kindly note that in line with the provisions of Article 7 "[...] Within 15 working days from registration of the application, the institution shall either grant access to the document requested and provide access in accordance with Article 10 within that period or, in a written reply, state the reasons for the total or partial refusal [...]". As already stated in the registration email of 23rd of November - [...] the official channel to be used is: EMSA website/ Publications/ EMSA Documents/Documents Request Form, that will ensure a prompt handling. As you have addressed your request to <<E-Mail-Adresse>>, there was a delay in its registration as request for public access to documents. As such, in line with the above and seeing the 1st of December was an EMSA public holiday, kindly note that the deadline for this access to documents application is 14th of December 2020. This is a reply to your application for access to documents registered on the 23rd of November 2020 by EMSA whereby you request: "The Memorandum of understanding between Frontex and EFCA on new Frontex Aerial Surveillance Services (FASS) concluded in 2019, and, if existing, such an agreement between Frontex and EMSA." The Agency processed your application in line with the provisions of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents. Whereby, in line with the provisions of Article 2 (3) – […] “This Regulation shall apply to all documents held by an institution, that is to say, documents drawn up or received by it and in its possession, in all areas of activity of the European Union […]”, in respect of the "Memorandum of understanding between Frontex and EFCA" requested, EMSA does not possess this document as we are not part of the respective agreement. Therefore kindly address one of the parties to the Memorandum of understanding, for access to documents related purposes. In respect of the second item as requested, namely "[...] if existing, such an agreement between Frontex and EMSA" , the agreement concluded with Frontex for a general collaboration in the scope of our Agencies given mandates is the "Service Level Agreement concluded between FRONTEX and EMSA for the provision of surveillance tools and services in support of Frontex activities, including for the implementation of the EUROSUR framework", document already disclosed in the context of a previous access to documents application which can be found here: https://www.asktheeu.org/en/request/a.... This SLA was subject to one amendment addressing only its duration which was modified to indefinite. Furthermore, in respect of your request for a direct reply to your given email address and not via a web platform - note that the platform used probably redacted this information from your application therefore the only contact detail that appears in your application is the email associated to your platform account. Note that, in line with Article 7(2) of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents, you may file a confirmatory application within 15 working days of receiving this email. Dear applicant, Kindly note that the referenced application was already answered by EMSA within the 15 working days interval from its registration, as per the provisions of Regulation (EC) No 1049/2001 of the European Parliament and of the Council regarding public access to documents. All exchanges are documented on the platform via which your application was submitted, and even yourself you have acknowledged the receipt of EMSA reply on the 8th of December 2020. Kindly refer to information publicly published: https://fragdenstaat.de/anfrage/memorandum-of-understanding-between-frontex-and-efca-frontex-and-emsa/ Chronological order of events/exchanges: - Application was received via unofficial channel, therefore the actual receipt by the Access to Documents Coordinator, analysis and final registration was made on the 23rd of November 2020 (as already highlighted in our registration email and final reply); - The deadline for reply in line with the provisions of Article 7.1 of Regulation (EC) No 1049/2001 is within 15 working days from registration of the application. In the context where the 1st of December was an EMSA holiday, the deadline for reply was calculated to the 14th of December 2020 (as already highlighted in our official reply of 8th of December 2020); - EMSA already replied to your application from the 8th of December 2020; - Applicant has acknowledged the receipt of the reply within the same day. Concluding, in line with the above and in reply to your enquiry - the status of your application is closed as this was answered within the 15 working days from its registration, as per applicable legal provisions quoted above.
