████████ █████████ ████████ ███████ Angers, 06/06/2019 Our ref.: FM-ACE/PA1133 – Open-Source Anwendungen und Betriebssysteme Your ref.: [#134238] RE: Public Access to Open-Source Anwendungen und Betriebssysteme Dear Mr. ████, On 26/04/2019, the Office received request for public access No PA1133 regarding a wide range of information regarding the open source and proprietary applications and operating systems used by the CPVO, as well as concerning details of the related costs in the last three calendar years. On 17/04/2019, and pursuant to articl e 7(1) and (3) of Regulation (EC) 1049/2001, the Office extended the time limit to reply to the abovementioned request and duly notified the applicant its intention. Please, find hereunder the reply of the Office: 1. Which open source applications applications and operating systems and op erating systems are used in your authority? and which proprietary The CPVO mainly uses Windows Servers and Linux Serv ers. For further information, you may consult the relevant call for tender and related documents available on TED-eTendering1. a) Name of the open source applications. The open source applications used by the Office include PdfCreator, Zabbix, Glpi/OCS, Mantis and Squid. The Office cannot grant access to the complete set of information in this regards, as it would undermine the Article 4(1)(a) of Regulation 1049/2001, “Institutions shall IT security of thetoOffice itself. Indeed, to refuse access a document where pursuant disclosure would un dermine the protection of the public interest as regards public security”. b) Name of open source operating systems The open source operating systems used by the Office are based on Linux. c) Name of proprietary applications The proprietary applications used by the Office include MS Office 2016 and Acrobat Pro X. The proprietary operating systems used by the Office are Windows and Mac OS. 2. For which tasks are these applicat ions and operating systems used? These applications and operating systems, namely Windows and Mac OS, are used for staff members’ workstations. 3. What is the share of open source applic proprietary applications and operating systems? ations and operating systems compared to The 20% of the applications and operating systems used by the Office are open source; while the 80% is proprietary. 4. What share do open standards and data formats have? 5. What costs (broken down into acquisition cost s and running costs) have been incurred in the last three calendar years for open source operating syst ems and applications on the one hand and for proprietary operating sy stems and applications on the other? 6. What additional costs, broken down by cost type, have been incurred in the last three calendar years for training, further education, support or similar, on the one hand for open source operating system s and applications and on th e other hand for proprietary operating systems and applications? Concerning the three questions above, please be info rmed that the Office does not possess the requested documentation2. As per Article 2(3) of Regulation No 1049/2001, “This re gulation shall apply to all documents held by an institution, that is to say, documents drawn up or received by it and in its possession, in all areas of activity of the European Union.” Therefore, the Office cannot comply with your request.
