Dear European Border and Coast Guard Agency, I am filing this confirmatory application in relation to my access to document request “request according to EU regulation 1049/2001 and 1367/2006” (reference PAD-2022-00144). My initial request, as well as all subsequent correspondence, can be found here: https://fragdenstaat.de/anfrage/shipw... The request: On 21. April 2022, I filed a request for access to the following documents: 1. All Serious Incident Report filed for the 21 and 22 April 2021. 2. For 21 and 22 April 2021, with regard to Frontex’s operational activities in the Central Mediterranean: - all Technical Equipment Mission Reports; - all ICC Daily reports and/or JCB Minutes; and - all Daily reporting packages. 3. For all assets deployed by Frontex in the Central Mediterranean, and involved in the above-mentioned events: - all positions logged during 21 and 22 April 2021;- all footage gathered during 21 and 22 April. 4. All correspondence issued and received by Frontex during 21 and 22 April with regards to, or mentioning the above-mentioned boat in distress. Please note that: - this includes, but is not limited to, all correspondence exchanged with Italian and Maltese authorities and actors,Libyan actors, NGO and civil society actors such as Alarm Phone, and any private actors such as merchant vessels; as well as Frontex internal correspondence; - this includes, but is not limited to, all e-mails (including all attachments), messages and notifications exchanged, as well as all phone call logs. On 28 April 2022, Frontex registered the application and denied access to most documents on 15 June 2022. This is a confirmatory application under Regulation 1049/20012, Art 7, based on four aspects of your response to my request: a) Concerning point 1 of the application and how the disclosure of the document would ‘negatively effect on the ability of Frontex and other parties to establish a meaningful cooperation or engagement with Libya’. b) Concerning point 1 of the application and the protection of the public interest. c) Concerning point 3 of the application, regarding information on assets deployed by Frontex. d) Point 1, 2, 3 and 4 regarding the ability of Frontex to provide and receive legal advice Regarding point a) I would like to request further explanation as to how the release of this document would negatively effect Frontex to ‘establish a meaningful cooperation or engagement with Libya’. Furthermore there is no specific explanation on how the release of these documents would ‘jeopardise the mutual trust of all parties, an essential prerequisite for establishing international relations, respectively for engaging with third countries.’ Regarding point b) I would like to request an explanation as to how the release of the SIR would ‘undermine the protection of the public interest as regards [to] international relations’? NGOs, members of the European Parliament as well as journalists constantly report about Frontex’s cooperation with the Libyan Coast Guard. The content of the requested documents is therefore a matter of public concern. As regards to Point a) and b) I’d like to request the decision not to disclose the document to be reconsidered in view of the principle of ‘widest possible access’ stipulated in Regulation 1049/2001. I would like to request that Frontex reconsidered if non-sensitive parts of the documents can be released in view of this principle. Regarding point c) I would like to have a clarification if the three documents you identified were part of "positions logged during 21 and 22 April 2021" or "footage gathered during 21 and 22 April"? As regards to Point c) I’d like to request the decision not to disclose the document to be reconsidered in view of the principle of ‘widest possible access’ stipulated in Regulation 1049/2001. I would like to request that Frontex reconsidered if non-sensitive parts of the documents can be released in view of this principle. Regarding point d) given that throughout the document it has been argued that ‘these documents pertain to the ability of Frontex to provide and receive legal advice’, I would like to request further explanation as to how the release of this document would hinder Frontex to receive and, more notably, provide legal aid.
