We would like to inform you that pursuant to Article 2(1) of Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents, the right of access to documents is granted to a citizen of the Union, and any natural or legal person residing or having its registered office in a Member State. Dear sir or madam, in response to my request based on the Regulation (EC) No 1049/2001 and the Regulation (EC) No 1367/2006 you have kindly asked me to provide proof of my identity as a citizen of the European union. I hereby decline to provide either a digital signature, which I simply can not provide, or a digital copy of my national identification card. Reasons being: 1. Article 2(1) Regulation (EC) No 1049/2001 states that any union-citizen may request access to documents, it does not require proof of identity for that citizen. 2. In accordance to Article 2(2) Regulation (EC) No 1049/2001, you may also provide information to non EU-citizens. 3. In conjunction with points one and two, as mandated by Article 6(1)(c) GDPR, you as a public bodies are only allowed to process personal data required to fulfill your legal obligations. As set out in the points one and two, you are not required to process this personal data of mine for identification when granting access to documents. I would like you to reconsider this practice, by raising the bar for access to documents you are contradicting Article 1(b) of the Regulation (EC) No 1049/2001. Dear sir or madam, I would kindly ask for your help with my request based on the REGULATION (EC) No 1049/2001 and REGULATION (EC) No 1049/1367/2006 to European Border and Coast Guard Agency (Frontex). I believe that my request for access to documents was not processed properly since they keep on requesting proof of my Identity as a EU-Citizen. The REGULATION (EC) 1049/2001 does not requite proof of identification, but is way more open in the other direction. They are, in compliance with Article 2 (2) of the very same regulation, even allowed to disclose information to persons (both natural or legal) that are not residing in the European union. By this they are violating the very purpose of this Regulation, as expressed in Article 1 (2). Scanning, obscuring unneeded information and transmitting my ID-Card is by no means the “easiest possible exercise oft [t]his right”. Since this is a sever violation of Article 6 (1)(c) GDPR, I have simultaneously filed a complaint with the European Data Protection Supervisor in response to Frontex’s behavior. With their behaviour in response to my request for access to documents based on the REGULATION (EC) No 1049/2001 and REGULATION (EC) No 1049/1367/2006 they are violating Art. 6 (1)(c) GDPR. They have requested a digital copy of my national ID-Card. This is highly sensitive information they are, since not mandated by any of these regulations, not allowed collect or process! I have informed Frontex that they are not allowed to process this data, but they still insist on proof of my identity. I kindly ask you to inform the institution that they have to process not only, but including, my request with their reference CMS-2019-00007-0149, but every request without proof of identity as a European citizen! Dear [geschwärzt], thanks for your reply and the copy of the agency's response. I think that frontex has not fully understood my point. While the GDPR may not apply to them, I also mentioned that scanning an redacting unneeded information is by no means the easy, it is raising the bar for access to documents a lot. Article 1 (2) of the reulation REGULATION (EC) 1049/2001 directly states that the exercise of a persons right for access to documents has to be as easy as possible. Please do not just to fulfill my request, but as a fundamental decision. Frontex is making it significantly harder to access documents held by them. Not everyone has a scanner and or the technical expertise to black out information on a scan. Parts of society are exempt from their well deserved right to learn more about the internals of government agencies. I therefore urge you to make your decision in a way that it makes access to documents easier for everyone! Thanks for your support in this case!
