"content": "HR EUROPEAN COMMISSION\n\n% + DIRECTORATE-GENERAL\n\n# * ENVIRONMENT\n\nx 4 Pa\n\n* The Director-General\n25 -1- 200\nBrussels, 3 ?\nD(2002) ENV.D2/LC/sh/526241\nYour Excellency,\n\nOn 14 November 2002, the European Court of Justice delivered a judgment in case\nC-316/00, Commission v Ireland which declared that:\n\n- by failing to ensure compliance with microbiological parameters 57 (total\ncoliforms) and 58 (faecal coliforms) of Annex I to Council Directive 80/778/EEC\nof 15 July 1980 relating to the quality of water intended for human consumption\nin respect of certain public water supplies and certain group water supplies\n(other than those providing less than 10 m? a day as an average or serving fewer\nthan 50 persons, unless the water is supplied as part of a commercial or public\nactivity) identified in official drinking water reports and in correspondence\nconcerning Ballycroy, Ireland, and\n\n- by Jailing, in its implementing legislation, to reflect the binding character of the\nrequirements of Annex I to the directive in relation to group water supplies,\n\nIreland has failed to fulfil its obligations under Articles 7(6), 18 and 19 of that\ndirective.\n\nBy virtue of Article 228, paragraph 1, of the Treaty establishing the European\nCommunities, if the Court of Justice finds that a Member State has failed to fulfil an\nobligation under this Treaty, the State shall be required to take the necessary measures to\ncomply with the judgment of the Court of Justice.\n\nIn accordance with paragraph 2 of Article 228 of the EC Treaty, the Commission would\nlike to draw to the attention of the Irish Government the fact that, where the Member\nState concerned does not take the necessary measures to comply with the Court of\n\nHer Excellency\n\nTREUIEICITME REN.\n\nPermanent Representation of Ireland\nTo the European Union\n\nRue Froissart 89-93\n\nB-1040 Brussels\n\nCommission europeenne, B-1049 Bruxelles / Europese Commissie, B-1049 Brussel - Belgium. "content": "Justice’s judgment, the Commission may refer the case back to-the Court of Justice. In\nso doing, the Commission shall specify the amount of the lump sum or penalty payment\nto be paid by the Member State concerned which it considers appropriate in the\ncircumstances. If the Court of Justice finds that the Member State concerned has not\ncomplied with its judgment it may impose a lump sum or a penalty payment on it.\n\nThe Commission has stated in its Communication dated 5 June 1996 concerning the\nimplementation of Article 228 of the EC Treaty (0.J. No. C 242 of 21/8/96, p.6) that it\nconsiders that a penalty payment is the most appropriate instrument to secure compliance\nas rapidiy as possible (point 4 of the Communication). The Commission has also\npublished the method of calculating the penalty payments provided for pursuant to\nArticle 228 of the EC Treaty in the Official Journal (0.J. No. 63 of 28/2/97, p.2); it is\nspecified that for the purposes of calculating the penalty payment, the duration of the\ninfringement runs from the date of the first Court Judgment. (point 3.2).\n\nAgainst this background, I would be grateful if by reference to the drinking water\nsupplies cited in the proceedings, your authorities could inform me of the measures taken\nby Ireland to comply with the judgment of the European Court of Justice delivered on\n14 November 2002.
