            "content": "IE a EUROPEAN COMMISSION\n\n30 -10- 1998\n\nBrussels,\nscoH)n 9135\n\n97/4409\n\nSir,\n\nI would like to draw your attention to the implementation by Ireland of\n2 Directive 80/778/EEC relating to the quality of water intended for human consumption\nar (\"the Directive\").\n\n1. Background\n\nComplaints P97/4048 and P4409\n\nIn 1997, the Commission registered a complaint against Ireland under number P97/4409\nconcerning microbiological contamination of Irish drinking . water supplies Benerally\n(one of the supplies being located at Ballycroy, County Mayo).\n\nReferring to the reports of the Irish Environmental Protection Agency (EPA) on the\nquality of drinking water in Ireland, the complainants in P97/4409 drew attention to\nwidespread problems of microbiological contamination (particularly of smaller supplies).\nThe complainants were especially concerned at the public health implications.\n\nz The contamination of the Ballycroy drinking water supply was the subject of other more\nK detailed complaints, namely P95/4078, which concerned the adverse environmental\neffects of sheep overgrazing in the west of Ireland, including adverse effects on the\nBallycroy drinking water supply, and P97/4048. The Commission ultimately took action\n\nOn 4 May 1995, the Commission wrote to the Irish authorities requesting information (letter from\nDirector-General, Directorate-Generai XI, to > Nee.             "content": "under Article 169 of the Treaty in respect of P95/4078, focusing on sheep overgrazing\nproblems affecting the implementation of Directive 79/409/EEC on the conservation of\nwild birds. Complaint P97/4048 again drew attention to the problems of the\nBallycroy drinking water supply, claiming that the water supply (which serves about\n170 houses and about 800 consumers) remained microbiologically contaminated; that, for\nsome years prior to Ballycroy consumers discovering through private testing the\nmicrobiological contamination of their water supply in 1994, the competent authority,\nMayo County Council (i.e. the sanitary authority charged with statutory responsibility for\nensuring compliance with the Directive) knew from its own tests that the water was\ncontaminated?; and that the Irish authorities did not take steps to discontinue the supply\nor take sufficient measures to ensure an uncontaminated supply and a notification of all\nconsumers of the risks.\n\nCorrespondence with the Irish Authorities\n\nFurther to these complaints, the Commission wrote to the Irish authorities on\n26 August 1997 seeking information and clarification on a range of issues.\n\nBy letter dated 23 April 1998, the Irish authorities provided a detailed response. In\nthis response, the Irish authorities argued, on the basis of the decision of the:\nEuropean Court of Justice in Case C-42/89, Commission v Belgium, that the Directive did\nnot apply to Irish group water schemes. Such schemes consist of water supplies provided\nfor consumers by private trusts or companies where a public water supply is unavailable;\nthe water supply for Ballycroy is an example. The Irish authorities also pointed to a range\nof measures intended to improve the quality of drinking water in Ireland and to protect\ndrinking water sources, without however committing themselves to ensuring that all\nIrish drinking water supplies coming within the scope of the Directive comply with\nits requirements.\n\n2 The complainants provided the Commission with copies of two 1992 County Council test results\nwhich are marked “polluted supply, unfit for human consumption”.\n\n2",

            "content": "Irish Drinking Water Reports\n\nSince 1991, the Irish authorities have prepared and published annual reports on the\nquality of drinking water ın Ireland?. Copies of these have been provided to the\nCommission, and cover the years 1989-1996 inclusive.\n\nThese reports point to serious and persistent problems of compliance with\nmicrobiological parameters 57 (total coliforms) and 58 (faecal coliforms) of Annex I of\nthe Directive. These problems mainly affect group water schemes, but problems are also\nevident in a significant number of public water schemes. The number of contaminated\ngroup water schemes is very high, with the persistence of contamination over years of\nmonitoring and the sometimes very high coliform values recorded adding to public health\nconcerns. By way of illustration, the main report for the year 1996 notes, in relation to\nmonitoring of group water schemes in County Mayo, \"as is almost invariably the case\nwith such schemes, there is a lengthy list of coliform exceedances, and it is indisputable\nthat very many of the supplies are subject to serious faecal contamination. The\nsalient cases are the faecal coliform occurances in the Belmont (Kilconly) GWS,\nCrossboyne GWS, Furnace, Bucklagh GWS, Raith GWS and Tulrahan GWS, but it must\n\n3 The drinking water reports were initially prepared and fublished by the Environmental Research\nUnit attached to the Department ofthe Environment. Since 1993, responsibility for the reports has\npassed to the Irish Environmental Protection Agency (EPA).             "content": "be stressed that every case of faecal contamination - however low - is a matter of serious\npublic health concern\"*.\n\n2% Legal Arguments\n\nDirective and Irish Implementing Legislation\n\nArticle 2 of the Directive defines \"water intended for human consumption\" to mean\ninter alia all water used for that purpose, either in its original state or after treatment,\nregardless of origin, supplied for consumption.\n\nArticle 7(1) of the Directive requires Member States to fix values applicable to water\nintended for human consumption for the parameters shown in Annex I. Article 7(3) limits\nthe discretion of Member States in fixing these values. Article 7(6) obliges\nMember States to take the necessary measures to ensure that water intended for\nhuman consumption at least meets the requirements specified in Annex I.\n\nArticle 9 of the Directive makes provision for derogations, but provides that in no case\nshall derogations relate to toxic or microbiological factors.\n\nArticle 12 of the Directive provides that Member States shall take all necessary steps to\nensure regular monitoring of water intended for human consumption, and also provides\nthat Member States shall conform with Annex Il.\n\nArticle 18 of the Directive provides that Member States shall bring into force the laws,\nregulations and administrative provisions necessary to comply with the Directive and its\nannexes within two years following notification. The Directive was notified to Ireland on\n18 July 1980. Hence the deadline under Article 18 expired on 18 July 1982\n\nArticle 19 ofthe Directive provides that Member States shall take the necessary measures\nto ensure that the quality of water intended for human consumption complies with the\nDirective within five years of its notification. The compliance deadline under Article 19\ntherefore expired on 18 July 1985.\n\nBy letter dated 6 May 1988, Ireland communicated as its implementing legislation for the\nDirective S.I. No 81 of 1988, European Communities (Quality of Water Intended for\nHuman Consumption) Regulations, 1988.\n\nBy letter dated 19 November 1992, Ireland informed the Commission that Section 58 of\n\nthe Environmental Protection Agency Act, 1992 gave the Irish Environmental Protection\nAgency a supervisory role in relation to the monitoring of drinking water.\n\n4  P213 ofthe Report.",

            "content": "Non-compliance with Micro-biological Parameters 57 and 58 in Public Water Schemes\nIreland does not dispute the applicability of the Directive to Irish public water schemes.\n\nInasmuch as the abovementioned official drinking water reports disclose non-compliance\nwith parameters 57 and 58 of Annex I of the Directive in certain public water schemes,\nIreland is in breach of its duties under Articles 7(6) and 19 ofthe Directive. etails of non-\ncompliant schemes are set out in the said drinking water reports. By way of extrapolation,\nnames and details of micro-biologically non-compliant schemes for the years 1993-1995\ninclusive are set out in the table annexed to the present letter.\n\nNon-compliance with Microbiological Parameters 57 and 58 in Group Water Schemes\n\nAs mentioned above, the Irish authorities in their letter dated 23 April 1998 argued that\nthe Directive was inapplicable to Irish group water schemes.\n\nThe Commission does not accept this argument for several reasons.\n\nFirst, as regards the scope of application of the Directive, the decision of the\nEuropean Court of Justice in Case C-42/89, Commission v Belgium, hinges on the notion\nof \"supply\" to consumers. The Court drew a distinction between water “supplied for\nhuman consumption” and water extracted from private wells for domestic use, accepting\nthat the latter were not covered by the Directive because the notion of a supply to\nconsumers did not arise. However, the notion of supply to consumers is clearly present in\nthe role that group water schemes play in providing water. In essence, such schemes are\nsuppliers of water to private and commercial consumers in the same way that water\ncompanies elsewhere in the Community provide water supplies to their consumers.\n\nSecondly, there-is a formal distinction between group wäter schemes and private\nindividuals acting on their own behalf. In terms of their legal constitution, the schemes\nare either trusts or corporate entities, with all the fixed and current assets of a scheme\nowned and controlled by the trust or company, and not by the individual consumers. The\nexample of Ballycroy illustrates this. The water network, which as previously mentioned\nservices in the region of 800 consumers, is operated by Ballycroy Water Company\nLimited, a limited company established under Irish law.\n\nThirdly, the Irish authorities themselves have recognised a distinction between group\nwater schemes and water which individuals provide for themselves. The abovementioned\ndrinking water reports describe group water schemes in a category apart from other small\nprivate supplies or wells. The Irish Department of the Environment has also\ndescribed group water schemes in terms of a separate category: it’s May 1997\nEnvironment bulletin, points out that an estimated 55 000 houses are connected to\nprivately sourced group schemes, 90 000 houses to publicly sourced group schemes and\nthat the 1991 Census showed that there were an estimated 130 000 households with their\nown private water supplies. The Commission considers that it is only the last category\n(i.e. the estimated 130 000 households) that falls outside the scope of the Directive on the\nbasis of the interpretation in Case C-42/89.",

            "content": "Fourthly, the arrangements between group water schemes and consumers are comparable\nwith the arrangements between any other type of utility and consumers. A group water\nscheme will only provide a water supply to a consumer on payment ofaa capital charge for\ninstallation, and will only supply water on payment of a regular standing charge. The\nrelationship between consumer and scheme is contractual, normally confirmed by a\nformal written contract.\n\nFifthly, in many cases group schemes will draw on sources of water which are in\npublic ownership or under public control, as is evident in the abovementioned\nEnvironment Bulletin.\n\nSixthly, group water schemes can in practice act as commercial drinking water providers\nto public bodies. This is again illustrated by the case of Ballycroy. The Ballycroy Water\nCompany Limited sells water to Mayo County Council to supply the population of\nInishbiggle Island. The Council buys the water on a metered basis and takes it from the\nBallycroy network directly to Inishbiggle. In addition, the Council has paid capital\ncharges to the Water Company in respect of water supply to Council houses in Ballycroy.\nThe Irish Department of Education and Department of Health also benefit from the water\nsupply, inasmuch as three national schools and a medical centre are supplied.\n\nFor all the above reasons, the Commission does not accept that group water schemes fall\noutside the scope of application of the Directive.\n\nGiven this, and given that the abovementioned official drinking water reports as well\nas correspondence in connection with Ballycroy disclose non-compliance with\nparameters 57 and 58 of Annex I of the Directive in many group water schemes, the\nCommission considers that Ireland is in breach of its duties under Articles 7(6) and 19 of\nthe Directive. Details of non-compliant schemes are set out in the said drinking water\nreports as well as correspondence in connection with Ballycroy. By way of extrapolation,\nnames and details of micro-biologically non-compliant schemes for the years 1995\ninclusive are set out in the Table annexed to the present letter.\n\nConformity of the Irish Implementing Legislation\n\nAn examination of the Irish implementing legislation for the Directive, S.I. No 81 of\n1988, European Communities (Quality of Water Intended for Human Consumption)\nRegulations, 1988, indicates that the legislation is not in conformity with the Directive in\nrespect of group water schemes.\n\nIrish sanitary authorities are the competent authorities assigned with the task of\ncomplying with these Regulations (and thereby ensuring compliance with the Directive).\nArticle 4 of the Regulations states that “it shall be the duty of a sanitary authority to take\nthe necessary measures to ensure that water intended for human consumption meets the\nrequirements of these Regulations.” However, in a situation where monitoring discloses a\ncompliance problem with a group water scheme, Article 8 of the Regulations limits the\nduty of a sanitary authority to giving a user warning and advising those operating the\nscheme of the measures which should be taken for the improvement of the water quality.\nNo duty is imposed on the companies or trusts operating group water schemes to comply\nwith drinking water standards, and sanitary authorities are not given any powers under the\nRegulations to require group water schemes to comply with such standards.\n\n6",

            "content": "The way in which the Irish legislation works is illustrated by the example of Ballycroy. In\ntheir letter to the Commission of 4 June 19965, the Irish authorities affirmed, with\nreference to the contamination of the group water scheme, that “it is a matter for the\ngroup scheme members and management to provide the necessary treatment facilities to\nmaintain water quality at acceptable levels.” It is implicit in this statement that, as far as\nthe Irish authorities are concerned, a sanitary authority - the only authority with statutory\nduties under the Regulations in respect of water supplied for consumption - is not\nresponsible for maintaining satisfactory water quality in respect of a group water scheme.\nAs the group water scheme is under no statutory obligation under the Regulations to\nmaintain such water quality in accordance with the Directive, the Regulations effectively\ntreat the requirements of Annex I of the Directive as being at most in the nature of\nadvisory guidelines so far as a group water scheme is concerned.\n\n‘ This falls short of what is required under the Directive, which leaves no ambiguity as\n\nregards the binding character of Annex I.\n\n‘ Thus even were Ireland to accept that group water schemes come within the scope of\n\napplication of the Directive, its transposition of the Directive would be deficient in\nrelation to such schemes. As a result, the Commission considers that Ireland has failed to\ncomply with its duties under Articles 7(6), 18 and 19 ofthe Directive.\n\n3, Conclusions\n\nIn conelusion, the Commission considers that Ireland is in breach of its obligations under\nArticles 7(6) and 19 ofthe Directive in as much as it has failed to ensure compliance with\nmicrobiological parameters 57 (total coliforms) and 58 (faecal coliforms) of Annex I of\nthe Directive in respect of certain public water schemes and certain group water\nschemes (identified in official drinking water reports and in correspondence\nconcerning Ballycroy), and is further in breach of its obligations under Articles 7(6), 18\nand 19 of the Directive inasmuch as it has failed, in its implementing legislation, to\nreflect the binding character of the requirements of Annex I of the Directive in relation to.\ngroup water schemes.\n\nIn these circumstances, acting under Article 169 of the EC Treaty, the Commission asks\n\nthe Irısh Government to submit its observations on the matters set out in this letter within\ntwo months of receiving it.\n\n5 See footnote 1.",
