I should nevertheless like to submit a confirmatory application, under Article 7.2 of Regulation 1049/2001, for reconsideration of your position. Please excuse that I was not able to file this application within the specified 15 day period.\n\n\nI would like the stress that in my opinion there is an overriding public interest in disclosure under Article 4 of Regulation 1049/2001 which stems from the fact that the European Union needs to be better prepared for future outbreaks of infectious deseases. This is also the opinion of your institution as well as that of the Council and Parliament (e.g. see https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:52020PC0726&from=EN ( https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:52020PC0726&from=EN )).\n\n\nTo be better prepared it is vital to analyse the early pandemic response on the European level. For this the (partial) disclosure of the requested documents would be highly beneficial.\n\n\nFurthermore it is specified under Article 7 of Regulation 1049/2001 that the exceptions given in Articles 7.1, 2 and 3 only apply for the period during which protection is justified. Since the European Union already has to some extend strengthened its capability to respond to infectious desease outbreaks I believe that a release of these \"old\" documents would not undermine public security and international relations anymore.\n\n\nAlso I want to ask you to reconsider your position on your refusal on a partial release of the requested documents under Article 4.6 of Regulation 1049/2001. I do not believe that every single bit of the information in the concerned documents falls under the exceptions given under Article 4.1 and is interrelated to such an extent that a partial disclosure would not be possible.
