Sehr geehrte Frau Ministerpräsidentin Schwesig,

Nord Stream 2 hat seinen Antrag für die Route durch dänische Hoheitsgewässer südlich von Bornholm
zurückgezogen. Dies wurde heute der Dänischen Energiebehörde (DEA) formell übermittelt. „Wir sehen uns zu
diesem Schritt verpflichtet, da die dänische Regierung in den zwei Jahren seit der Antragstellung keinen Hinweis auf
eine Entscheidungsfindung gegeben hat,“ erklärte Matthias Warnig, CEO der Nord Stream 2 AG. „Sowohl Nord
Stream 2 als auch unsere Investoren sind jedoch auf Rechtssicherheit und den Investorenschutz angewiesen, was
einen transparenten und berechenbaren Entscheidungsprozess bedeutet. Dies umso mehr, da der Bau in den
Gewässern von vier weiteren Ländern bereits weit fortgeschritten ist.“

Das Genehmigungsverfahren für die Route nordwestlich von Bornholm hat gezeigt, dass alle technischen und
ökologischen Voraussetzungen erfüllt werden können und eine Genehmigung nach internationalem Seerecht
(UNCLOS 1982) erteilt werden kann. Der Antrag für den Routenverlauf südöstlich von Bornholm wird bearbeitet.
Eine in diesem Rahmen kürzlich durchgeführte öffentliche Anhörung hat keine besonderen ökologischen oder
technischen Probleme aufgezeigt. Daher konzentriert sich Nord Stream 2 nun auf diese beiden Routen. Das
Unternehmen wird weiterhin konstruktiv mit den dänischen Behörden zusammenarbeiten, um die zeitnahe
Genehmigung einer Route sicherzustellen.

Die Rücknahme des ersten Antrags ist notwendig, um das Risiko von weiteren Verzögerungen und finanziellen
Verlusten für den Anteilseigner von Nord Stream 2 und die europäischen Investoren aus Österreich, Frankreich,
Deutschland und den Niederlanden zu mindern.

Die Gasproduktion in der EU wird sich bis 2035 halbieren und mehr Importe werden benötigt. Deshalb wird die
zeitnahe Fertigstellung von Nord Stream 2 zur Versorgungssicherheit und zu stabilen Gaspreisen für die
europäischen Verbraucher beitragen. Die Pipeline wird ebenfalls bei der Verringerung der CO2-Emissionen helfen,
weil mehr Erdgas in der Stromerzeugung umweltschädlichere Kohle ersetzen muss.

Rückblick auf das Nord Stream 2-Genehmigungsverfahren in Dänemark

Vor mehr als zwei Jahren reichte Nord Stream 2 die Umweltverträglichkeits-prüfung (UVP) und den Bauantrag für
die Route durch dänische Hoheitsgewässer ein, die entlang der von den dänischen Behörden bevorzugten Route
der bestehenden Nord Stream-Pipeline verläuft. Anschließend wurde der gesetzliche Rahmen geändert. Der
dänische Außenminister hat nun das Recht, auf der Grundlage nationaler und internationaler Erwägungen gegen
die Verlegung von Rohrleitungen in Hoheitsgewässern Einspruch zu erheben. Das bedeutet, dass der Minister eine
positive oder negative Empfehlung zu einem Bauantrag vor der Bearbeitung durch die DEA abgeben muss. Eine
derartige Empfehlung ist seit dem 1. Januar 2018, als das neue Gesetz in Kraft trat, nicht erfolgt. Bis heute gibt es
keine Hinweise darauf, wann dieses Verfahren abgeschlossen wird und wann eine Genehmigung durch die DEA
erteilt werden könnte.

Nord Stream 2 hat zwei weitere Genehmigungsanträge und Umweltverträglichkeitsprüfungen eingereicht: Im
August 2018 wurde eine Route nordwestlich von Bornholm beantragt, gefolgt von einem weiteren Antrag für eine

Route südöstlich von Bornholm im Mai dieses Jahres. Beide Routen liegen innerhalb der dänischen ausschließlichen
Wirtschaftszone und außerhalb der Hoheitsgewässer von Dänemark. Daher ist eine Empfehlung des
Außenministers hier nicht erforderlich. Die Genehmigungsentscheidung unterliegt nur einem Verfahren gemäß
dem Seerechtsübereinkommen der Vereinten Nationen (UNCLOS), wonach die Behörden die Verlegung von
Rohrleitungen unter Berücksichtigung der Umwelt und der Schiffsverkehrssicherheit zulassen müssen.

Nord Stream 2 has withdrawn its application for the route through Danish territorial waters south of Bornholm,
thus terminating a more than 2-year lasting procedure. A formal notice letter was handed to the Danish Energy
Agency today. “We felt obliged to take this step because in more than two years since we filed this application, the
former Danish government has not given any indication of coming to a decision”, explained Matthias Warnig, CEO
of Nord Stream 2. “But both Nord Stream 2 and our investors need legal certainty and protection of legitimate
expectations, which means a transparent and predictable decision-making process, especially against the backdrop

of the advanced construction progress in the waters of the four other countries through which the pipeline
stretches.”

The procedure for handling the application for the route north-west of Bornholm has been completed and shown
that all technical and environmental prerequisites can be fulfilled, and a consent to the route as envisaged by
UNCLOS1982 can be granted. The application for south-east of Bornholm is still being processed, but the public
consultations recently held have also demonstrated no significant environmental and technical concerns.
Therefore, Nord Stream 2’s focus is now on these two routes. Nord Stream 2 will continue to work constructively
with the Danish authorities to ensure the timely consent for a route on the continental shelf.

The withdrawal of the original application is necessary to.protect Nord Stream 2’s shareholder and the. European
investors from Austria, France, Germany and the Netherlands against the risk of further delays and financial losses.
As the EU’s domestic gas production is expected to halve by 2035, more imports will be needed. Therefore, the

‚timely completion of Nord Stream 2 will contribute to.a secure energy supply and stabile gas prices for European
consumers, as well as helping reduce CO2 emissions by enabling natural gas to replace more polluting coal in
power generation.

The history of the Nord Stream 2 permitting procedure in Denmark

More than 2 years ago, Nord Stream 2 submitted the Environmental Impact Assessment (EIA) and application for
the route through Danish territorial waters which follows the proven route of the existing Nord Stream pipeline
preferred by the Danish authorities. Subsequently the Continental Shelf Act was amended giving the.Minister for
Foreign Affairs the right to veto the laying of pipes in territorial waters based on national and international
considerations, meaning that the Minister has to give a recommendation on the application — positive or negative -
prior to handling by Danish Energy Authority (DEA). Such recommendation has been pending since January 1, 2018,
when the new law came into force. Even until today, there has been no indication as to when this process would
end and thereby.when a permit could be granted by DEA.

Nord Stream 2 also has two further pending applications and EIAs— one with a route north-west of Bornholm
submitted in August 2018 and one with a route south-east of Bornholm submitted in May this year. Both ofthese
routes are fully within the Danish exclusive economic zone, outside of Danish territorial waters. Consequently, a
recommendation from the Minister for Foreign Affairs is not required and the decision on the consent to the route
is only subject to an open handling process in accordance with the United Nations Convention on the Law ofthe
Sea, known as UNCLOS, whereby the authorities must allow the laying of pipes taking into consideration the
environment and ship traffic safety.
