2. Objectives
Overall objective: Strengthened national mechanisms for addressing migration issues in Libya.
Specific objectives:
1. Legislative and institutional frameworks addressing regular and irregular migration are
enhanced;
2. Cooperation between relevant stakeholders on regular and irregular migration at
international and national level is improved.
3. Context
Since the appointment by the Eastern-based House of Representatives (HoR) of the former
Government of National Accord (GNA) Minister of Interior, Fathi Bashagha, as the prime minister of a
new parallel Government of National Stability (GNS) in February 2022, Bashagha has made several
attempts to enter Tripoli. Notably, his most recent attempt in August 2022 prompted armed clashes
and heavy fighting between rival militias, including in densely populated neighbourhoods in the
capital, resulting in civilian injuries and deaths. Following the withdrawal of Bashagha and his troops,
the situation has returned to relative calm, while the political deadlock remains and the electoral
process sees continued delays.
The United Nations (UN) continued to mediate talks between the opposing parties during negotiations
that took place in Cairo during several rounds of talks between April and June 2022, with delegates
from the HoR and the High Council of State (HCS), in an attempt to reach consensus on a constitution
to be put to a referendum before the holding of elections. Following the first two rounds of talks,
during which the parties reached an initial agreement on 137 articles of the constitutional draft, the
rival factions failed to reach a final consensus during the 3rd and final round of negotiations that took
place mid-June, with one of the main contentious topics reportedly including the criteria for
presidential candidacy. Subsequently, new negotiations between the two parties hosted by the UN in
Geneva at the end of June in another attempt to reach consensus, also failed to reach a final
agreement. After a period without a UN Special Envoy for Libya, agreement was reached on a new
Special Representative and Head of the UN Support Mission in Libya (UNSMIL) on 2 September with
the appointment of the Senegalese diplomat and former minister Abdoulaye Bathily.

4. Coordination with International Actors
During the reporting period, the project team participated in a number of formal coordination fora
and held bilateral meetings with other international stakeholders working on Libya to ensure synergy,
cost-efficiency, and to avoid duplication with other actions. Table 1 below provides an overview of the
coordination meetings in which ICMPD participated during the reporting period.

5. Update on the project status and implementation of activities
During the reporting period, the project team held meetings with several project stakeholders with
the aim to advance on the implementation of the project. See table 2 for an overview of the meetings
held with the Libyan project stakeholders, which had the main objective to advance on the start of the
project implementation. In parallel, a number of activities were implemented during the reporting
period, as presented in Table 3. In addition, a virtual briefing was organised on 19 September 2022
with the donors of the project to present the 3rd Quarterly Narrative Report and to present a general
update of the project.

Regular phone calls with the ICMPD Focal point in the MFA (several times/week)
A number of meetings were held with the Libyan stakeholders with the view to finalise the approval
process of the project. ICMPD was informed that the International Organisations Department (MFA)
is still waiting for the official approval of the project activities from a number of stakeholders following
the OSC meeting that took place on 31 May 2022. Subsequently it was agreed with the MFA in
September 2022 that ICMPD can start with the implementation of activities with the stakeholders who
approved the project (the MoI and the NTBSM), while waiting for the approval of the other
institutions. In this regard, a bilateral virtual meeting was organised with the MoI on 26 September
2022 to discuss the activities to be implemented. During the meeting, the MoI reiterated its interest
and readiness to start the organisation of the activities. However, in light of the recent appointment
of a new Minister of Interior as well as several new MoI officials who will be involved in the work with
ICMPD, the MoI recommended to organise a two-day briefing in Tunis for the new MoI officials, to

jointly discuss the way forward. As such, it was agreed to organise a two-day mission to Tunis on 24
and 25 October.
Several positive meetings were also held with the Director of the MFA’s Expatriate Affairs Department
and his team, who expressed their interest to work on the topics of Consular Crisis Preparedness and
Management as well as the Engagement of Libyans Living Abroad. ICMPD was informed that the
proposed activities align with the needs and plans of the Expatriate Affairs Department, so they are
ready to start the work on these topics and launched the internal procedures for an approval of their
involvement. While waiting for the official approval from the Expatriate Affairs Department2, ICMPD
sent a 5th Note Verbale on 8 September 20223 re-proposing the organisation of the “Programme
Design Consultation Meeting for a Training Programme on Consular Crisis Preparedness and
Management” reaffirming that ICMPD stands ready to start the organisation of the activities the
soonest.
With respect to the MoJ, a fruitful meeting was held with the new Director of Relations and
International Cooperation of the MoJ, who confirmed the interest of the MoJ to work on several of
the activities proposed by ICMPD. It was agreed that the MoJ will share their strategy outlining their
priority areas the soonest and based on the strategy, ICMPD will share an updated matrix with
proposed activities in line with the strategy of the MoJ.
ICMPD had an informal meeting with the MSMA in Tunis. The MSMA representatives underlined that,
while the Minister had relocated to Benghazi, the institution in Tripoli is still operational. In this
respect, they noted that they shared their official approval of the LIBMITAF project with the MFA
following the OSC meeting and reiterated their interest to work with ICMPD. They “capacity
enhancement training on migration concepts, terminology and management” was discussed and the
MSMA representatives expressed their interest to participate.
During the reporting period, while waiting for the outstanding approvals of the project activities,
ICMPD continued with the implementation of the activities with respect to Libya’s participation at the
international and regional migration dialogues. In parallel, the preparation for a number of other
activities continued to ensure that ICMPD is ready to start the implementation the soonest.

General Activities
Assessment of Good Practices as regards Shelters for Migrant Women and Children

During the reporting period, ICMPD has continued the work on the finalisation of the assessment and
mapping of good practices in four countries with respect to the policies and legislation relevant for
the establishment of shelters for migrant women and (unaccompanied as well as accompanied)
children.
Development of an IDPs Legal Assessment for the National Durable Solutions Strategy
A meeting was held with
to discuss the work on the National Durable Solutions Strategy for Libya
(previously the National IDPs Strategy) and the re-launch of the potential support that ICMPD could
give to the initiative. Following a request from the UN to contribute to the development of a Libyan
National Strategy on IDPs, ICMPD supported the initiative that was launched during the previous EU-
funded project “Strategic and Institutional Management of Migration in Libya” with a mapping of all
the relevant laws related to the Libyan legislative framework on IDPs and their protection (see section
4.14. of the LIBMITAF Inception Report). ICMPD has been informed that the process has been re-
launched and ICMPD has expressed its interest to take up the work with respect to the legal
assessment for the National Durable Solutions Strategy, which was very welcomed by the UN Resident
Coordinator’s Office. Subsequently, it was agreed with hat ICMPD will continue the
work on the legal assessment, which is planned to be finalised during the next QNR reporting period.
Activity Strand 1: Facilitation for Libyan delegations’ active participation in international
and regional migration dialogues
Support Libya with the development of a training module on migration dialogues for the
Diplomatic Institute

During the reporting period, ICMPD also continued the development of a training module on migration
dialogues with the view to allow for the long-term and sustainable continuation of transfer of relevant
knowledge with respect to international and regional migration dialogues to Libyan diplomats. ICMPD
was informed in July that the Director of the Diplomatic Institute had left for a new posting and that
the work on the curriculum was put on hold until the nomination of his successor. A new Director of
the Diplomatic Institute was appointed in September 2022. ICMPD is therefore planning to meet the
new Director of the Diplomatic Institute during a mission to Tripoli in October to present the work of
ICMPD and to discuss the planned activities with respect to the training module on migration dialogues
and the migration dialogue trainings.

Preparation meeting for the Khartoum Process Thematic Meeting on “Legal Pathways: Talent
and Skills Mobility Partnerships to Match Labour Market Needs”

In preparation for the participation of the Libyan Delegation to the Thematic Meeting on “Legal
Pathways: Talent and Skills Mobility Partnerships to Match Labour Market Needs”, a virtual meeting
was organised with a representative of the Khartoum Process Secretariat and the Libyan Khartoum
Process Focal Point. The preparation meeting was an opportunity to brief the Libyan Delegation on
the modalities and topics of the conference as well as to prepare them for their participation.
Participation in Khartoum Process and Rabat Process Dialogues
During the reporting period the participation of Libyan delegations to the migration dialogues
continued, with the participation of Libyan delegations to (1) the Rabat Process “High Level Thematic
Meeting: Cooperation between Countries of Origin, Transit and Destination in the field of Border
Management” in Madrid, Spain from 5 – 6 July; (2) the Khartoum Process “Legal Pathways: Talent and
Skills Mobility Partnerships to Match Labour Market Needs” in Mombasa, Kenya from 12 – 13 July; and
(3) the Rabat Process “High Level Thematic Meeting on State Cooperation as a Key for Success in
Labour Migration” in Malaga, Spain from 29 – 30 September.
Activity Strand 2: Support to Libyan authorities in their efforts with respect to consular crisis
preparedness and engaging Libyans living abroad
Preparation for the work with respect to consular crisis preparedness and engaging Libyans living
abroad is ongoing and ICMPD stands ready to organise the “Programme Design Workshop to define
the training programme on Consular Crisis Preparedness”4 and an “Activity Design Workshop on
engagement of Libyan living abroad” to define the activities to be implemented on the two topics
jointly with the relevant Libyan stakeholders as soon as the Expatriate Affairs Department has given
its official approval to start the work. Following the very positive meetings held with the Expatriate
Affairs Department on 21 June and 31 August 2022, during which the Director of the Expatriate Affairs
Department expressed its interest to work on both the topics of Consular Crisis Preparedness and the
engagement of Libyans Living Abroad, ICMPD was informed that the work on these topics can start as
soon as the Expatriate Affairs Department sends its official approval.
Activity Strand 4: Support to the Libyan Civil Society Organisations working on migration in
reinforcing their work and roles
CSO briefing paper:
Throughout the reporting period, ICMPD continued its strong engagement in the CSO Coordination
Group, a forum of more than twenty international actors working in Libya and with Libyan CSOs that
aims at enhancing information sharing and cooperation among international actors on their work with

Libyan organisation. The Group thus provides a space for international implementers to share good
practices and lessons learned from their own experiences and offers the opportunity to avoid
duplication of work and the overburdening of beneficiaries.
In addition to participating to the fourth plenary meeting of the Group in July 2022, ICMPD has closely
collaborated with the Group in drafting a CSO briefing paper titled “Insights and recommendations for
meaningful engagement of Civil Society Organisations in Libya”, which at the end of the reporting
period was in the process of being finalised. The paper aims to provide a general understanding on
what it means to work with Libyan CSOs as an international actor, and what are the main
recommendations to follow when engaging with Libyan organisations based on the experience and
lessons learnt by the CSO Coordination Group’s members themselves. The document mainly targets
the donor community and other international stakeholders interested in providing support to Libyan
CSOs. Throughout the drafting process, ICMPD proactively reached out to the Group’s members to
first discuss the ideas for paper’s structure, and afterwards to coordinate and provide inputs for the
editing process. Once finalised, the paper will also be translated into Arabic to allow for wider
dissemination.
List of CSOs with which ICMPD plans to work:
While the preparation for the activities with Libyan CSOs were ongoing, ICMPD was suggested by the
Libyan authorities to send to the MFA the list of CSOs with which ICMPD plans to work under the
LIBMITAF project. ICMPD compiled the list to be sent through official Note Verbale by including the
name and geographical location of the Libyan organisations.
In order to ensure a conflict-sensitive approach and to eliminate any potential harmful consequence
for CSOs themselves, ICMPD bilaterally contacted all CSOs’ representatives and specifically asked for
their consent to be included in such an exercise. The vast majority of Libyan CSOs agreed to be
included in the list and ICMPD is currently waiting for the MFA to give authorisation to send the
abovementioned CSOs’ list.
6. Upcoming Plans
The following project activities are planned and/or will be continued during the fourth quarter of
20225:
General Activities:
3-day “capacity enhancement training on migration terminology, concepts, and
management”, with the view to delivering a general training to the relevant Libyan
stakeholders to train them on the relevant migration concepts6 pending the two-day
briefing session with the MoI officials in Tunis on 24 – 25 October, this activity will be
organised the soonest with participants of the MoI, the NTBSM, the MSMA, and the MFA
Expatriate Affairs and International Organisations Dept.;

The capacity enhancement training was added to the planned activities in response to a specific request by the MSMA,
asking for a specific training on migration terminology and concepts, which also serves as preparation for other activities
organized within the framework of this project.

The development of the Legal Assessment for the Durable Solutions Strategy.
Activity Strand 1 - Facilitation for Libyan delegations’ active participation in international and regional
migration dialogues:
Continue the work in supporting Libya with the development of a training module on
migration dialogues;
Participation of Libyan delegation to the Rabat and Khartoum Process Thematic Meeting on
“Climate Change and Migration: Addressing Impacts & Adaptation Strategies for Human
Mobility in the Context of Climate Change” from 5 -7 October in Addis Ababa, Ethiopia;
Participation and accompaniment of the Libyan delegation to the “Senior Officials’ Meeting”
on 20 October in Madrid, Spain;
Participation and accompaniment of the Libyan delegation to the “Sixth Ministerial
Conference of the Rabat Process” from 13 – 14 December in Cádiz, Spain;
After the finalisation of the training module on migration dialogues, two-day trainings on the
migration dialogues for Libyan diplomats.
Activity Strand 2 - Support to the Libyan authorities in their efforts with respect to consular crisis
preparedness and engaging Libyans living abroad
The re-launch of the programme design workshop for a training programme on consular crisis
preparedness, a preparatory workshop for the design of the Training of Trainer programme
on consular crisis preparedness;
Activity Design Workshop on engagement of Libyan living abroad to jointly design the
activities to be implemented on this topic;
Start on the work to support to Libya with the development of a communication strategy for
the engagement of Libyans living abroad.
Activity Strand 3 – Support to and strengthening of the efforts of the Libyan authorities in the field of
migration legislation
Re-launch of the “Follow-up and prioritisation of the Legal Assessment’s recommendations
workshop” to jointly define the content of all the activities on migration legislation pending
the approval from the MoJ, this workshop will be organised as a first activity to jointly define
the content of all the activities to be implemented on the topic.
The activities are planned to be organised in person in Tripoli, Libya, but depending on the political
and security context and/or the availability of experts, the format might need to be changed to a
virtual or hybrid set-up or to a different venue.
