International Centre for Migration Policy Development nr C Libya Office a > | M P D Palm City Residences - Piazza, Janzour xy Tripoli, Libya International Centre for www.icmpd.org Migration Policy Development ICMPD-Libya@icmpd.org Subject: Attachment to NVXXX/2022/LBYMFA/LBY/2022-10-XX Response to the Strategic Plan shared by the Ministry of Justice We would like to express our highest appreciation for sharing the strategic plan related to the field of training and development shared by the Ministry of Justice. After studying the strategic plan of the Ministry of Justice in detail, we have the honour to propose the following activities to contribute to the achievement of the training plan of the Ministry within the framework of the EU and Swiss Confederation co-funded project “Libya’s Migration Technical Assistance Facility (LIBMITAF)”. ICMPD proposes the following activities in response to your strategic plan: As a first general activity, a “Follow-up and prioritisation workshop” is proposed with the purpose to jointly discuss and define with the Ministry of Justice the details of the upcoming cooperation. The workshop will be an opportunity for the Ministry of Justice and ICMPD to discuss the Ministry’s strategy and the proposed activities in detail to make sure that the activities that will be implemented correspond to the needs and key priorities of the Ministry of Justice. We believe that it would be very beneficial to have this joint workshop between the Ministry and ICMPD the earliest, as it will enable us to design together all activities for the future (proposed date for the half-day workshop: 5 or 6 December 2022). A number of technical trainings and capacity enhancement activities are proposed, which can partly contribute to the objective of topic 1 of the Ministry of Justice’s strategic plan: “Technical trainings and capacity building targeting the members of the judiciary system, and how they can dismantle criminal networks in compliance with international standards”: o Two “Training of Trainers (ToT) sessions” focusing on all applicable Libyan laws in relation to migration, with the aim to train and equip several trainers of the Ministry of Justice to train staff of the Ministry of Justice on the current Libyan legal standards; o Two “Trainings on all applicable Libyan laws in relation to migration” to be led by the Ministry’s trainers who finalised the Training of Trainers programme; o A “Presentation and analysis of international standards as regards migration” for the judiciary; o Two further capacity enhancements on specificthemes can be added on the request of the Ministry of Justice (the selected themes could be defined during the “Follow- up and prioritisation workshop”). With regard to topic 3 in the Ministry of Justice’s strategic plan “Organizing study visits and field visits to some of the European Union (EU) countries, to exchange experience and learn from their positive practices”, ICMPD proposes to organise a “Study visit” (location to be determined) on a legislative theme that the Ministry would like to discuss with its peers from

an EU country with the view to exchange expertise and good practices. The exact theme will
be jointly identified during the “Follow-up and prioritisation workshop”.
e With regard to topic 5 in the Ministry of Justice’s strategic plan “Enhancement of judicial
cooperation and exchange of expertise between the State of Libya and the EU as regards the
fight against cross-border crime”, ICMPD, with the understanding that the Ministry intends an
exchange of experience, proposes to include this in the “Study visit” to allow for the exchange
of expertise with a relevant EU country. In addition, ICMPD proposes to further discuss this
issue during the “Follow-up and prioritisation workshop” to jointly define which country is of
particular interest for the Ministry to share experiences and work on bilateral judicial
cooperation.
e With regard to topic 2 in the Ministry of Justice’s strategic plan “Providing technical support
to the centre of judiciary expertise and research in the management the file of the dead bodies
of migrants, especially the forensic medicine department of the centre that deals and save
thousands ofsamples on daily bases, as these bodies remain with unknown identity” and topic
4 in the strategic plan “Implementing programmes particularly related to international
cooperation in the field of requests for international cooperation advanced by investigating
authorities, i.e. the Public Prosecution, to their counterparts in other countries and vice versa,
the parties to the UN Convention Against Transnational Against Transnational Organised
Crime, particularly as regards the Protocol concerning the fight against illegal migration and
human trafficking”, ICMPD would need further information to better understand the precise
support that the Ministry would require. ICMPD therefore proposes to discuss these points
during the in-person meeting proposed to the Ministry on 10 November 2022.
e Withregardto topic 6 “Creating a national database in the Public Prosecutor’s Office including
statistics on crimes related to illegal migration issues and human trafficking, criminal
networks, and linking it to the EU database to facilitate exchange and analysis of information
and access to justice”, ICMPD currently does not havethe resources to create such a database.
However, ICMPD could create a virtual/online database for legal literature on migration.
ICMPD suggests to discuss during the “Follow-up and prioritisation workshop” if this is of
relevance to the Ministry of Justice.
Most ofthe proposed activities will take place in Tripoli with the view to facilitate a wider participation.
At the same time, the proposed activities include one study visit, the destination of which will be
defined in full collaboration and agreement with the Ministry.
We would like to highlight that all the above-mentioned proposals will be implemented by ICMPD only
following agreement on the details of the activities with the Ministry of Justice during the “Follow-up
and prioritisation workshop”. If any of the proposed activities do not respond to the needs and
priorities of the Ministry, ICMPD stands ready to adapt or remove such activities from the proposed
work plan.
