JHA agencies network in 2019

Dear European Institute for Gender Equality,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting:

For all of the meetings of the Justice and Home Affairs (JHA) agencies' network held in 2019:

1. All agendas of these meetings;
2. A list of all attendees, including the name and Unite of the agency each attendee represents;
3. All presentations by any of the agencies' representatives shown during the course of these events;
4. All documents prepared by the agencies for the purpose of these meetings and handed out or distributed among the attendees (such as – but not limited to – handouts, leaflets, briefings or background notes);
5. All reports, summaries, minutes, notes, or record-keeping of any kind produced by EIGE or any other agency as an outcome of these meetings;
6. All correspondence - issued and/or received both before and after the meeting - related to, mentioning, or regarding the meetings.

I am also requesting all documents held by EIGE with regards to any and all cooperation around public access to documents and Regulation 1049/2001 within the JHA agencies' network. This includes, but is not limited to:

1. All correspondence - including e-mails, messages, notes and letters, as well as all attachments - issued or received by EIGE mentioning, discussing or with regards to public access to documents and/or Regulation 1049/2001 in the framework of the JHA agencies' network;
2. All reports, notes, briefings, presentations, papers and documents of any kind regarding, mentioning or relating to public access to documents or Regulation 1049/2001 which have been produced or exchanged in the framework of the JHA agencies' network;
3. For any meeting - in addition to the meetings mentioned in the first half of my request - held with regards, mentioning or relating to public access to documents or Regulation 1049/2001 in the framework of the JHA agencies' network:
a) all agendas of these meetings;
b) a list of all attendees, including the name and Unite of the agency each attendee represents;
c) all presentations by any of the agencies' representatives shown during the course of these events;
d) all documents prepared by the agencies for the purpose of these meetings and handed out or distributed among the attendees (such as – but not limited to – handouts, leaflets, briefings or background notes);
e) all reports, summaries, minutes, notes, or record-keeping of any kind produced by EIGE or any other agency as an outcome of these meetings.

We have assessed your request and collected all the documents held by the Institute pertaining to your request. Please note that this large number of documents need to be assessed by screening and hiding all personal data before its release, in line with Article 4(b) of Regulation 1049/2001. Moreover, the documents originating and/or created by other Institutions that may contain sensitive information are subject to third party consultation before we can release them, in line with Article 4(4) of Regulation 1049/2001. In order to finalise the processes above we need to extend the deadline with 15 working days (new deadline 10 September 2021), in line with Article 7(3) of Regulation 1049/2001. Pursuant to Article 6(3) of Regulation (EC) No 1049/2001 ('the Regulation'), we proposed a fair solution for dealing with your request for access to documents, registered on 19 August 2021 under the reference number D/705. We explained that such a fair solution could consist of narrowing down the scope of your request (i.e. the subject matter(s) and/or timeframe covered), so as to reduce it to a more manageable amount of documents. We did not receive a reply in this respect. Having examined your application, within the manageable timeframe and availability of resources, we assessed that your application concerns the following documents, that are in the possession of the Institute: - agendas and work plans of the JHA network - Reports of activity of the JHA network - Presentations on different topics of the JHA Agencies - Invitations to JHA meetings (letters or emails) - Discussion papers - consultations on access to documents requests among JHA Agencies - DPO presentations and DPO trainings Please note that some documents had to be expunged of personal data in accordance with Article 4(1)(b) of Regulation 1049/2001. In the course of assessing your application, we conducted third party consultations in accordance with Article 4(4) of Regulation 1049/2001. As a result of this consultation, the following documents were flagged under applicable exceptions pursuant to Article 4 of the Regulation, therefore access to these documents cannot be granted: - list of participants - flagged in their entirety by exception under Article 4(1)(b). Their disclosure would undermine privacy and the integrity of the individual, in particular in accordance with Community legislation regarding the protection of personal data. - JHA meetings' notes and minutes- flagged by exception under Article 4(1)(a) and Article 4(3). The disclosure of this information to the public would undermine the protection of the public interest as regards public security. These documents contain sensitive information that provides internal details relating to the activities and operations of the various agencies, as well as internal assessments and opinions. The disclosure of the documents to the public could jeopardize the trust and mutual cooperation between Agencies and their partners, which is essential the Agencies' activities, consequently hindering their ability to effectively perform their tasks. - Fiche 12 on Classified and marked documents- the applicable exemption is: Art. 4 (3) 2nd indent – document for internal use, the disclosure of which would seriously undermine the institution’s decision-making process. - Secretary General’s newsletter 5 with the title “Partial access: Adobe Acrobat Professional with Windows 10”- The applicable exemption is: Art. 4 (3) 2nd indent – document for internal use, the disclosure of which would seriously undermine the institution’s decision-making process. Due to the size, we will proceed with sending you the documents in the list attached in several emails. We kindly ask you to confirm their well receipt.
