which form an integral part of this Agreement, "the Agreement".

The terms set out in the Special Conditions shall take precedence over those set out in the other parts of the Agreement.
The terms of the General Conditions shall take precedence over the other Annexes,

Following the entry into force of the European Border and Coast Guard Regulation? (hereinafter the EBCG Regulation),
Frontex together with the national authorities of the Member States which are responsible for border management,
including coast guards to the extent that they carry out border control tasks, constitute the European Border and Coast
Guard (EBCG). The main task of this new EBCG is to implement European integrated border management as a shared
responsibility of the Agency and the national authorities.

SPECIAL CONDITIONS

ARTICLE 1 - SUBJECT MATTER

The subject matter of the Agreement is the deployment of Host MS resources:
- the deployment of technical equipment in Frontex’ operations.

ARTICLE 2 - ENTRY INTO FORCE AND DURATION
1. This Agreement enters into force on the date on which the last party signs it.

2. The implementation of the Agreement may not begin before the date on which the Agreement enters into force
unless the Beneficiary demonstrates the need to start the activity before the Agreement enters into force. In any
case the start day of the activity should not be earlier than 60 calendar days before the date of entry into force of
the Agreement and should not be earlier than the date of the submission of the offer under the ABN/FAR.

3. The Agreement is concluded for the activities

4. The period of implementation of the activity shall determine the period of eligibility for Frontex financial support.

ARTICLE 3 - MAXIMUM AMOUNT AND FORM OF GRANT
1.  Thetotal eligible cost of the activity is estimated at EUR 799,300.00 as shown in the estimated budget in Annex V.

2. The total eligible cost includes overheads of 1% of the eligible direct costs in accordance with the General
Conditions.

3.  Thetotal eligible cost may include a contingency to be used in accordance with the provisions of Article 1.16 of the
General Conditions.

4. The maximum total amount to be paid by Frontex under this Agreement is EUR 799,300.00 [seven hundred ninety
nine thousand three hundred], equivalent to 100% of the estimated total eligible cost indicated in paragraph 1.

5. The final amount of grant to be paid to the Beneficiary is calculated on the basis of eligible costs actually incurred
except those categories of costs where simplified forms of funding are allowed in accordance with the relevant MB
decision.

6. The final amount of the grant shall be determined in accordance with the General Conditions.

ARTICLE 4 - BANK ACCOUNT

Payments shall be made to the Beneficiary’s bank account or sub-account denominated in Euro, as indicated below:

ARTICLE 6 - DATA CONTROLLER

The data controller according to the General Conditions is the Executive Director of Frontex.

ARTICLE 7 - OTHER SPECIFIC CONDITIONS
The General Conditions are supplemented by the following:

1. In addition to the reporting requirements specified in Article 1.19 of the General Conditions, the beneficiary shall
