Dear Director General

| have been asked by my authorities to refer to infringement procedure

A90/5220 concerning the implementation of Directive 76/464/EEC

(pollution caused by certain dangerous substances discharged to the

aquatic environment) which is the subject of a Reasoned Opinion issued

‚on 12 June, 1997, and to the Commission's related letter of 3 March,” NDI37 3%
LLRPB: forwarding a series of enquiries concerning the Catchment- Based
x Strategy Against Eutrophication, "Managing Ireland's Rivers and Lakes"

which has been presented as my authorities' pollution reduction

programme for phosphorus, as required by Article 7 of the Directive.

The enquiries raised in the most recent letter cover a wide range of issues,
some of which are addressed in considerable detail. My authorities are
presently engaged in the preparation of a detailed response, a process
which involves consultation with anumber of Government Departments
and State Agencies. The response will be forwarded to the Commission as
soon as possible.

In view. of the active attention being given to these matters and their
relevance to the infringement procedure in respect of Directive
76/464/EEC, my authorities wish to request that a decision by the
Commission Services on the Reasoned Opinion in this case be deferred at
the forthcoming meeting which will review the situation generally in
relation to such procedures against Member States.

A reply deaiing with the matters raised in tne Reasoned Opinion, other
than the pollution reduction programme for phosphorus/my authorities'

Catchment-Based Strategy Against Eutrophication, is being finalised and
will be forwarded to the Commission later this month.
