I have been asked by my authorities to refer to your letter dated 28 July 2000 and my responses of 26 September and 5 December 2000 regarding Complaint 90/5220 conceming Directive 76/464/EEC on pollution caused by certain dangerous substances discharged into the aquatic environment ofthe Community. My authorities have asked me to forward a copy of the Water Quality (Dangerous Substances) Regulations, 2001 (S.I. No 12 0f 2001) which were made by the Minister.of State at the Department of the Environment and Local Government on 30 January 2001. These Regulations give further effectto Directive 76/464’EEC and complement the Local Government (Water Pollution) Act, 1977 (Water Quality Standards for Phosphorus) Regulations, 1998 (S.I. No 238 of 1998) previously notified to the Commission. This notifieation is also sent to the Commission in accordance with Article 24.2 of the Water Framework Directive 2000/60/EC. The Regulations will support implementation ofthat Directive (which incorporates Directive 76 46-4’EEC): in general terms with particular reference to articles 4. IOand II. The substances covered by the Regulations include pesticides, solvents and metals. selected on the basis of their use or presence in Ireland and their potential impacts on waters by virtue oftoxicity. persistence or bivaccumlation. The Environmental Protection Agency are being requested to develop a comprehensive monitoring programme so as to ensure full and effective implementation ofthe Regulations.
