THE COUNTY COUNCIL OF THE COUNTY OF CORK ——— 22 1.55 COUNTY OF CORK (REGULATION OF 4 GRICULTURAL PRACTICE IN THE CATCHMENTS OF THE RIVER LEE, THE RIVER GRADOGUE AND THE RIVER F UNSHION) BYE-LAWS 1999 The County Council of the County of Cork in exercise of the powers conferred upon it by Section 21 of the Local Government (Water Pollution)(Amendment) Act, 1990 hereby makes the following Bye-Laws in relation to agricultural practice in the catchments of the River Lee, the River Gradogue and the River Funshion. 1. DEFINITIONS: A. m Q [umm) INTENSIVE FARMING means an agricultural enterprise where there is no link between crop and animal production. Most nutrients are imported in the form of cereal based animal feeds or in the form of imported substrate. REPS PLANNING means the Rural Environment Protection Scheme run by the Department of Agriculture and Food MORGAN’S PLEVEL means the estimated level of available soil phosphorous as measured using Morgan’s Extractant (a solution of acetic acid and sodium acetate at pH 4.8). DOELG means Department Of The Environment And Local Government. DOAFF means Department Of Agriculture Food And F orestry. CATCHMENT AREA of the River Lee is as per Schedule I CATCHMENT AREA of the River Gradogue is as per Schedule II CATCHMENT AREA of the River F unshion is as per Schedule III PEAT SOILS; Soils where the surface peat layer is greater than 15cm deep. ORGANIC FERTILISERS; Refers to all farm animal excreta, i.e. from cattle, pigs, poultry, etc., including slurry, dungstead and farmyard manures, silage effluents, mushroom compost, soiled water and non-farm organic wastes containing nitrogen or phosphorous such as sewage sludge, industrial wastes and residues from fish farms that are used to promote grass or other crop production. CHEMICAL FERTILISERS; Chemical fertilisers which contain either phosphorous or nitrogen.
L. NUTRIENT MANAGEMENT PLAN ; means a plan which has the objective of integrating the nutrients contained in organic fertilisers with chemical fertiliser usage so as to achieve the right balance between crop requirements and nutrient application rates consistent with the prevention of water pollution. M. IMPORT; means to transport material from any location outside the farm onto the farm PHOSPHATE FERTILISER SALES REGISTER: All retail outlets within the County who offer for sale phosphate containing fertilisers in bags equal to or exceeding 50 Kgs weight or in bulk, shall maintain a register of all such transactions undertaken. The register shall detail the name and address of the customer, the amount, and type, of fertiliser sold and the date of the transaction. The registers shall be made available for inspection and copying by members of the environmental staff of Cork County Council. SOIL TESTING: All farms in excess of 20 ha. in size, and smaller farms where an intensive farming enterprise i.e. pig, poultry, or mushroom, is ongoing, shall have nutrient soil tests carried out which are representative of uniform areas ofthe farm at a rate not exceeding 4ha./sample. Where previous soil analysis and soil type indicate very uniform areas, the rate of soil testing may be increased to a maximum of 12 ha./sample. Each uniform area shall be sampled and tested at least once every 5 years. Where soil analysis indicates Morgan’s P level below 6mg/l the farm may apply to Cork County Council for a derogation to reduce this testing frequency. The sampling, analysis, and reporting shall be conducted by companies or bodies approved for REPS planning by the Department of Agriculture and Food. The results shall be made available for inspection by Cork County Council staff on request. PHOSPHATE APPLICATIONS LIMITS: No chemical fertiliser containing phosphate shall be applied to grasslands within the catchment areas except in the event that documented soil tests taken from the lands in question indicate that the Morgan’s P level is below 15mgj/l. In the case of peat soils only, the Morgan’s P level must be below 30 mg/l. The application of chemical fertiliser containing phosphate to lands shall be based on current TEAGASC nutrient advice at the time of application. TIMING OF NITROGEN APPLICATIONS: No chemical fertiliser containing nitrogen shall be applied to lands within the catchment areas between the first of October and the first of January of the following year, inclusive. Chemical fertiliser containing nitrogen may be spread at rates of up to 60kgN/ha between first of January and end of February, if soil and weather conditions are suitable. No slurry/farmyard manure shall be applied in January or February on lands which receive chemical fertiliser containing nitrogen at this time.
10. TIMING OF SLURRY/FARMYARD MANURE APPLICATIONS: All slurry/farmyard manure produced during the period when animals are housed shall be landspread by 31 October each year. Slurry/farmyard manure should be landspread in accordance with the July 1996 DOE/DOAFF recommendations as contained in the “Code of Good Agricultural Practice to Protect Waters from Pollution by Nitrates”, in particular the recommendation that states “As a general practice, slurry and other concentrated organic fertiliser applications to land should be avoided during the non-growing season which varies throughout the country, depending on local climatic conditions, between the months of October and February”. Farms in the catchment areas shall have a minimum ofthree months slurry storage for all cattle overwintered. Any slurry/farmyard manure applied to lands destined for tillage shall be incorporated into soils as soon as possible after application. BUFFER ZONES: No organic fertiliser spreading shall be carried out within the following distances of the following specified locations; Location; Buffer Strip (m) Streams and Drains 10 Lakes and Main River Channels 15 Domestic Wells 50 Public Water Supply Sources 100 RECORDING OF ORGANIC AND CHEMICAL FERTILISER USE: All farms within the catchment areas shall maintain a monthly record of the amounts, locations and dates of applications of organic fertilisers and chemical fertilisers made to lands. The type and nutrient content of chemical fertiliser applied shall also be recorded. Records shall be made available to Environmental staff of Cork County Council on request. IMPORTATION OF ORGANIC FERTILISERS: Any farmer wishing to import organic fertilisers shall notify the Local Authority giving details ofthe proposed importation. Imported organic fertilisers can only be applied on lands where documented soil tests taken from the lands in question indicate that the Morgan’s P level is below 15mg/l. ORGANIC AND CHEMICAL NITROGEN APPLICATION LIMITS: On lands within the catchment areas where groundwater nitrate levels exceed 20 mg/l, applications of organic nitrogen shall not exceed 210 kg/ha. On all other lands within the catchment areas applications of organic nitrogen shall not exceed 250 kg/ha. These figures include the nitrogen in organic manure deposited by grazing animals. Applications of chemical fertiliser containing nitrogen shall not exceed the prevailing TEAGASC recommended levels, with regard to crop type, stocking rate, etc., at the time of application.
11. STORAGE AND MANAGEMENT OF ORGANIC WASTES ON THE F ARM: All effluents generated in farm yards shall be adequately contained in suitable tanks and managed in accordance with the July 1996 DOE/DOAFF recommendations as contained in the “Code of Good Agricultural Practice to Protect Waters from Pollution by Nitrates”. Surface waters from roof drainage shall not be allowed to mix with polluting material in slurry tanks or effluent tanks but must be discharged separately to local watercourses or soakaway. PENALTIES:- 12; 13% Any person contravening or failing to comply with these bye-laws is guilty of an offence pursuant to Section 21(3)(a) ofthe Local Government (Water Pollution)(Amendment) Act, 1990 Offences arising from failure to comply with, or contravention of these bye-laws, shall be liable to the penalties in accordance with Section 21(3)(b) ofthe Local Government (Water Pollution) (Amendment) Act, 1990. Fines for contravention or non-compliance are as set out in Section 21(3)(b) ofthe aforementioned Act.
