all documents you possess regarding the queuing mechanism/system. As I am unsure which exact documents you possess, I am in particular interested in documents that state how this queuing mechanism was established, how it is justified and what Frontex' thoughts were behind the mechanism. Was the agency "inspired" by the approach of EMA? In other words, how exactly did the application of the mechanism start and what were the stages to develop it and what principles/justifications is it based on. Any document to support my research would be highly appreciated. Regarding the decision you received from the European Ombudsman, I am already in possession of the meeting request sent by the European Ombudsman to your agency and your reply to the complaint sent on 23 March 2021. Please be informed that Frontex does not hold any documents further to those referred to in the reply of 23 March 2021 in CASE 2067/2020/MIG held by you as Frontex does not operate a “queuing mechanism”. However, all offers in finding a solution – together with applicants - under Articles 6(3) and 15(1) of Regulation (EC) No 1049/20011 are made on a case-by-case basis and the suggestion to queue applications constitutes just one possibility further to, e.g. offering to narrow down, and depends on all circumstances at hand. Furthermore, such offer may also come from an applicant and need to be accepted by both sides. Pursuant to Article 7(2) of Regulation (EC) No 1049/2001, within 15 working days of the receipt of this letter, you may submit a confirmatory application to Frontex to reconsider its position. Based on Article 8 of Regulation (EC) No 1049/2001, Frontex will reply to you within 15 working days from the registration of such application.
