All documents provided to the Consultative Forum (CF) in response to their request for Serious Incident Reports (SIRs) related to alleged violations of fundamental rights reported to Frontex and investigated in Greece from 2016 to date. These are to include: a.        Facts and findings b.        Follow up measures taken by the Agency for years 2018 and 2019 Please be informed that Frontex identified nine documents, which are herewith attached. Kindly note however, that some limited parts of the letter of 27 February 2019 fall under exceptions under Article 4(1)(a) of Regulation (EC) No 1049/2001 and therefore had to be expunged with detailed justifications next to them. Similarly, some limited parts of remaining four documents, i.e. the Fundamental Rights Officer Reports to Management Board, Fundamental Rights Officer General Reports on Serious Incident Reports and Mission Report had to be expunged as they contain personal data such as names of individuals and/or characteristic features which could lead to the identification of individuals. Their disclosure would undermine the protection of privacy and the integrity of the individual, in particular in accordance with European Union legislation regarding the protection of personal data and therefore has to be precluded pursuant to Article 4(1)(b) of Regulation (EC) No 1049/2001. Kindly be reminded that the copyrights of the documents rest with Frontex and making these works available to third parties in this or another form without prior authorisation of Frontex is prohibited. Pursuant to Article 7(2) of Regulation (EC) No 1049/2001, within 15 working days of the receipt of this letter, you may submit a confirmatory application to Frontex to reconsider its position. Based on Article 8 of Regulation (EC) No 1049/2001, Frontex will reply to you within 15 working days from the registration of such application.
