CG boat was dispatched to the scene and 2 irregular migrants were taken from the sea. As 1 of the irregular migrants was unconscious, he was transferred to Cesme Port and delivered to 112 Emergency Service staff. It was learnt that the mentioned person died at the hospital. 3 additional CG boats, 1 CG helicopter and 1 CG Diving team were immediately dispatched to the scene at the same time. As a result of the SAR operations, 2 people were detected on Bogaz Island and rescued. Dead bodies of 2 irregular migrants were taken on the surface of the sea. In line with the statements of the irregular migrants, it was learnt that they were put in plastic handcuffs and beaten by Text Removed - Reporting Tools Their possessions were seized. They were directly left to the sea without any lifeboat or inflatable boat. They were 7 people in total. SAR operations are still ongoing for the purpose of finding 1 missing person. Legal investigation on the incident has been launched by Cesme Public Prosecutor. Having in mind the statement of the Text Removed - Reporting Tools and that no additional information or evidence was obtained neither from the Text Removed - Reporting Tools to corroborate the alleged facts, Text Removed - Reporting Tools recommends the closure of the SIR. Despite the fact that according to the response from the national authorities and considering the repetitive nature of such allegations, including other similar cases reported through Frontex SIRs, Text Removed - Reporting Tools would like to emphasize potential risks in incidents of such nature. The incident involves allegations on so called „pushback” of a rubber boat full of migrants conducted by the Text Removed - Human Resources to the border with Turkey without taking into consideration the personal circumstances of people present on board. Such law enforcement action may amount to collective expulsion, which Article 19 of the EU Charter explicitly prohibits. The European Court of Human Rights (hereinafter ”ECtHR”) ruled in several cases that the lack of specific examination of each individual situation in case of removal of aliens might amount to a collective expulsion. The ECtHR has reiterated that collective expulsion is “any measure compelling aliens, as a group, to leave a country, except where such a measure was taken on the basis of a reasonable and objective examination of the particular case of each individual in the group”. The lack of individual assessment and any general assessment of the situation in Turkey, which seems to be applicable in this case, is at odds with the prohibition of refoulment. Article 19 of the EU Charter, specifically prohibits collective expulsions, and provides that no one may be removed, expelled or extradited to a State where there is a serious risk that a person would be subjected to the death penalty, torture or other ill-treatment. The allegations relate as well to the Text Removed - Human Resources conduct that potentially amounts to degrading treatment of persons in a vulnerable situation, which is specifically prohibited by Article 4 of the EU Charter. As defined by the European Court of Human Rights (hereinafter ”ECtHR”), degrading treatment is an ill-treatment which arouses in victims’ “feelings of fear, anguish and inferiority capable of humiliating and debasing them and possibly breaking their physical or moral resistance”. Such alleged acts directly interfere with the right to human dignity which as set by Article 1 of the EU Charter, must be respected, and protected. Furthermore, in the course of aforementioned Coast Guards’ actions, it is clear that the persons subjected to these actions did not have access to an effective remedy when transferred to the border with Turkey. As provided by Article 47 of the EU Charter, the persons whose rights and freedoms guaranteed by law of the EU are violated have the right to an effective remedy. Moreover, in this context, Text Removed - Human Resources would like to underline the importance of the investigative procedure to be conducted in a full compliance with the principles of impartiality, objectivity, and confidentiality. Text Removed - Human Resources has repeatedly called for involvement of the central internal control units in investigations where fundamental rights allegations are at stake, even at the local level with a clear supervisory role. Such control should ideally be carried out by fundamental rights experts/focal points at central level of Member States authorities where this figure exists. Following the established investigation/inquiry procedures in such cases is of outmost importance to guarantee an adequate treatment of the information and procedural safeguards of the interviewed persons. The Aegean Boat Report published the following information: *Allegations published by AEGEAN BOAT REPORT: | A boat is in distress north-east of Lesvos carrying approximately 30 people, many of them children, the boat has been drifting for several hours after a patrol boat from the Hellenic coast guard took the engine off the boat and dropped it in the sea. Turkish coast guard is informed of their location since the boat now is inside Turkish waters.

Measures/Actions taken Assessment Final outcome and 3 ALB and Text Removed - Human Resources continued to run after the irregular migrants. 1-2 ALB police officers shot all together 10-15 warning shots to make the irregular migrants to stop. After reaching the irregular migrants they were apprehended by officers. The ALB officer(s) put the irregular migrants to sit on the ground. One ALB officers who was wearing on the Frontex armband pointed with his weapon the irregular migrants to the head and said "Bang, Bang, Bang". Later on another ALB officer yelled to the irregular migrants "I will kill you mother fuckers". Later on the irregular migrants were apprehended and transported by ALB police to the further investigations. Above discribed situation was eye-witnessed by Text Removed - Human Resources - See Incident- and Text Removed - Reporting Tools attached to this SIR process. Request from Text Removed - Reporting Tools engaged, Text Removed - Reporting Tools Text Removed - Reporting Tools contacted Text Removed - Reporting Tools and informed him about the case. Text Removed - Reporting Tools informed about SIR further proceeding according to the Text Removed - Reporting Tools According to the statement no pictures were taken from the reported event. Local authorities are conducting investigation related to the above mentioned case. Immediate measures were already taken by local authorities to suspend the main concerned local officer 20.01.2021: Text Removed - Reporting Tools informed that The Albanian Police immediately suspended the police officer who has fired the warning shots and also the other police officer who was using inappropriate communication with migrants. Albanian police will also adapt the national operational briefing for their own police officers. One attempt was on 28.11.2020 in the afternoon. Here there was a group with a mixed composition. There were also migrants from Africa. They tried to cross the river at the coordinate Text Removed - Operational Area with a rubber dinghy and get to Greece. This given co-ordinate has been converted to decimal degrees: | Text Removed - Operational Area and resulted in a location in the Text Removed. - Operational Area on the Greek side. According to a Google Maps map, this is clearly the territory of Greece. On the Turkish side, the small village of Text Removed - Operational Area is not far away.
