INDICATIVE PHASES OF THE ACTION The Action intends to build upon what has been achieved in relation to migration management in Bosnia and Herzegovina in recent years. The proposed Action is divided into three phases: ¢ Inception Phase ¢ Implementation Phase ¢ Finalisation Phase The project Inception Phase (months 1-3) is considered the preparatory stage and will contain important activities to achieve expected project results. In particular, it will include the set-up of the project management structure (PSC', PIT?) and the fine-tuning of the Action's work plan. Additionally, this phase is envisaged to introduce and elaborate 1) project internal monitoring and evaluation tools, such as flash reports on the implementation status and evaluation forms for activities, 2) launching the implementation of project communication and visibility plan, and 3) developing ToRs for ! different project activities. On the technical side, project staff will be selected and recruited, and the project team will be recruited under the currently running structure of the ICMPD Office in Sarajevo, Bosnia and Herzegovina. The PIT will be responsible for the elaboration and finalisation of the Inception Report, which will be presented to the PSC. The Inception Report will be submitted to the Delegation of the European Union to Bosnia and Herzegovina (EUD) for approval, following comments of the beneficiary. The report will also include the detailed Work plan and updated logical framework, and the main milestones for further project implementation. The Implementation Phase (months 4-9) will encompass all main project activities under the four project components. Although all four project components have their expected results, they are designed to complement each other, thus contributing to achieving sustainable and effective project outputs. Throughout this phase, monitoring and evaluation tools designed and adopted during the Inception Phase will regularly review the achieved results and possibly recommendations for improvements, which will be included in the Interim project Reports. Assistance will aim to support better management of the mixed migration flows in Bosnia and Herzegovina by improving capacities for the accommodation of migrants in temporary reception centers in Bosnia and Herzegovina by establishment of the temporary detention facilities for migrants within the multi-purpose reception centre Lipa in line with European and international standards. The implementation phase will commence with a comprehensive assessment ¢ design and technical specifications of the temporary detention facility of the multi-purpose reception centre at Lipa and needed equipment, and resume with constructing and equipping the new space for detention facility, development of the necessary legal basis for establishment and functioning of the detention facilities and related regulations and standardized operational procedures in line with international and EU standards. The action will end with the training of the staff of the detention facility for the implementation of the legislation, regulations and standardized operational procedures, as well as international and EU standards. Upon a review the current facilities of the multi-purpose reception centre Lipa and needs of the beneficiary institions, and in coordination with MoS, FAS and EUD a design and technical Page 22,48
specifications of the new space for detention will be deloped, where, in specific cases, measures of detention and restrictions of movement can be implemented pursuant the Law on Aliens of Bosnia and Herzegovina and in line with international and EU standards, within the multi-purpose reception centre at Lipa, and needed furniture and equipment. Under Component 2 a new space new space for detention will be construted, where, in specific cases, measures of detention and restrictions of movement can be implemented pursuant the Law on Aliens of Bosnia and Herzegovina and in line with international and EU standards, while providing shelter and basic services until a final decision is taken on asylum or return, and procure specified furniture and equipment. Component 3 will aim to support related institutions and agencies to put the necessary legal basis for establishment and functioning of the detention facilities and related regulations and standardized operational procedures pursuant the Law on Aliens of Bosnia and Herzegovina and in line with international and EU standards, in place. Technical assistance to support the implementation will be provided. Component 4 aims to enhance capacities of the staff deployed in the detention facilities to efectivelly implement the legislation, regulations and standardized operational procedures, as well as international and EU standards related to the functioning of the detention facilities. This final project phase will last three months (months 10-12) and will be devoted to completing and evaluating all project activities under the aforementioned four components. The specific results of the project will be presented in the Final Report. The final project activity will be the closing meeting of the PSC. 4.3. The main assumptions during and after the implementation phase of the project are related to the political will of national and local authorities to participate in and endorse the results of the Action and the choice of the institutions to continue implementation of the project outcomes after the official project end. The respective agencies collaborate effectively to achieve the objective of the project. This includes the readiness of the BiH institutions to nominate appropriate participates to the project management structures and activities, provide relevant information necessary for project implementation, actively participate in all project activities, and contribute to project results on the strategic and operational levels. The project will focus on institutional sustainability as described above. This project's financial sustainability aims to improve capacities for the accommodation of migrants in temporary reception centers in line with European and international standards, which requires the ownership and commitment of BiH institutions including further funding. 4.4. CROSS-CUTTING ISSUES Good governance and a rights-based approach will be at the core of the support given to the beneficiaries. The integration of a perspective on gender and particular attention to vulnerable groups of the public in the delivery of targeted services is also pertinent. In migration and mobility, progress on effective implementation of the different components of the EU-BIH Partnership is another cross- cutting priority. Upholding the rights of individuals migrating throughout BiH is a key issue that will be featured in all the activities, meetings, and trainings related to this Action. Specific activities to increase the standards of the accommodation of migrants in detention facilitiy in line with international and EU standards. The project will seek synergies with other actions implemented by other international organisations and partners in Turkey to avoid any duplication and/or overlap. In particular, cooperation and information exchange will be established with the following projects: ¢ Individual measure to strengthen the response capacity to manage migration flows in favour of the Western Balkans for 2022, designed to respond to the most urgent needs such as food, accommodation, medical assistance and access to education and social protection. The Action will contribute to further upgrade reception centres. Special attention will be put on the specific needs of vulnerable groups. The Action also aims at enhancing social cohesion, improving the resilience of local communities. Finally, the Action will strengthen border and migration control capabilities as well as returns, while fully respecting fundamental rights of persons concerned. 4.5. o Ministry of Security - Foreigners Affairs’ Service of Bosnia and Herzegovina o Ministry of Security - Border Police o Ministry of Security - State Investigation and Protection Agency o Ministry of Security - Directorate for Coordiantion of Police Bodies of Bosnia and Herzegovina o Ministries of Interior of: Federation of Bosnia and Herzegovina, Republika Srpska, cantons and Police of Br¢ko District of Bosnia and Herzegovina Civil society and local communities are significant stakeholders in the development and monitoring of migration issues. Their role is currently limited by several factors mainly linked to regional instability and the nature of the migration flows. The rights holders are identified as migrants and other people on the move in BiH. These are the key rights holders addressed by the Action. Key human rights principles relevant to this group include protection from any form of discrimination, access to assistance and protection from harm. In the BIH context, groups at risk of rights violations include migrant workers, individuals seeking international protection, women travelling alone, unaccompanied and separated minors, and individuals with irregular legal status. 5. IMPLEMENTATION 5.1. ORGANISATIONAL SET-UP AND RESPONSIBILITIES In order to achieve its overall objective, this 12-month intervention will be implemented by ICMPD, which is the signatory of the Contribution Agreement and the project implementing partner, with the overall responsibility for coordination with the EU and the stakeholders involved. In order to ensure coordination between the Action components and the numerous stakeholders, a Project Steering Committee (PSC) will be established to guide the implementation of the Action. The PSC will be chaired by the main beneficiary and co-chaired by ICMPD and will include representatives from main migration management actors in BIH and the EU Delegation (EUD). ICMPD will also be responsible for general technical support, preparing the agendas, sending invitations and the PSC's minutes. The PSC will meet every three months. Additional thematic technical working groups will be established under each component and include the implementing partners to ensure closer coordination among the stakeholders, and will consist of - as appropriate - implementing partners from other EU funded projects operating in the field of border management. Relevant civil society organisations and development partners will also be invited to the technical meetings when needed. ICMPD's project manager (PM) will function as the focal point for project beneficiaries and is fully responsible for coherence and synergies between this Action and other projects in BIH implemented by other parties and for supervising the daily work of project staff. The PM will organise regular meetings with the beneficiaries and other stakeholders to keep all parties involved informed about project progress, outstanding matters, potential setbacks, unpredictable changes and/or any needed adjustments. Reporting English is the language of reporting. All reports and visibility items will be drafted in impeccable English. Whenever needed, reports and visibility items will be translated into one of the the official languages of BiH. ICMPD will provide to the EUD four reports in cooperation and coordination with beneficiaries: Namely, an inception report (in the 4™ month of the project implementation), two mid-term (interim) reports (in the tth and 10" month of project implementation) and a final report (to be submitted within six months after project activities have finished). Financial reports will accompany the mid- term and final reports. The EUD will approve the reports. Complementing these reports, quarterly common activity flash reports will be submitted by ICMPD to the EUD and SCM members before each SCM meeting, highlighting the state of implementation and potential challenges and lessons learnt. Management Structure The overall management of the project will be based at the ICMPD Office in Sarajevo, under the leadership of the ICMPD Head of Region for Turkey and Western Balkans based in Istanbul. The core project team will include a project manager and project assistant, all based in Sarajevo. In addition, the ICMPD Headquarters in Vienna will provide thematic expertise and specialist support to the project. Please see the Budget (Budget Justification) for the action for further details on the composition of the project management team and division of roles and responsibilities. 5.2. MONITORING During the Inception Phase, ICMPD will develop a monitoring evaluation and learning (MEL) plan for the project and establish a theory of change. The purpose of this theory of change will be to ensure that all partners have a clear, shared view of what the project will achieve and how it will achieve it. It will then serve as the basis for developing a project logic model and results matrix, Page 27 s48
which will include (1) clear project objectives, (2) defined outputs and outcomes aimed at contributing to project objectives, (3) indicators at each level (disaggregated to assess gender and human rights mainstreaming) to track progress toward objectives, (4) baseline, targets, means of verification and assumptions, and (5) project staff roles and responsibilities for M&E data collection and reporting, including external evaluator(s) to help establish a baseline and assess overall project results. Once developed, ICMPD will share this MEL plan with all project partners for their review and input. Apart from ICMPD internal monitoring, the EUD may undertake additional project monitoring visits, both through its own staff and through independent consultants recruited directly by the Commission for independent monitoring reviews, such as Result- Oriented Monitoring (ROM) or recruited by the responsible agent contracted by the Commission for implementing such reviews. 5.3. EVALUATION Mid-term and final evaluations will be carried out for this Action or its components by ICMPD Monitoring and Evaluation experts. Services of external experts will be contracted on a needs basis. The evaluation reports will be shared with the partner country and other key stakeholders. The implementing partner and the EUD will analyse the conclusions and recommendations of the evaluations and, where appropriate, in agreement with the partner country, jointly decide on follow-up actions and any adjustments necessary, including, if indicated, the reorientation of the project. 5.4. COMMUNICATION AND VISIBILITY This Action shall contain communication and visibility measures, which shall be based on a specific communication and visibility plan. Regarding legal obligations on communication and visibility, the EUD, the partner country, contractor, grant beneficiaries and/or entrusted entities shall implement the measures. Appropriate contractual obligations shall be included in, respectively, this Contribution Agreement. The overall communication objective for this Action is: ¢ to ensure that through outreach to target groups, the Project has the maximum impact on the strengthening of Migration Management in BIH in line with EU standards and EU acquis; ¢ as well as to ensure the visibility of the EU's continued support to BIH in migration management and the achievements of BIH national stakeholders. The Communication and Visibility Plan closely follows the guidelines of Communication and Visibility in EU-financed external actions® and are attached in Annex IV. This plan provides a set of tools that will be updated and adapted to needs arising during the implementation of the project and upon possible comments of the stakeholders. The Outputs and Indicators, Targets and Baselines included in the log frame are indicative and will be updated during the implementation of the action, i.e. no amendment being required to the financing decision. Logical framework and Activity matrix The Logical Framework (log frame) matrix should evolve during the Action (i.e. the projects) lifetime: new lines can be added for listing new activities as well as new columns for intermediary targets (milestones) when it is relevant, and values will be regularly updated in the column foreseen for reporting purpose (see "Current value"). The term "results" includes Overall Objective (impact), Specific Objective (outcome), Other outcomes and Outputs.
