Februar 2021 worin Sie einen Antrag auf Dokumentenzugang stellen, der am selben Tag unter dem oben genannten Aktenzeichen registriert wurde. Ihr Antrag wird derzeit bearbeitet. Allerdings sind wir nicht in der Lage, die Bearbeitung innerhalb der vorgegebenen Frist von 15 Arbeitstagen, die am 11. März 2021 abläuft, abzuschließen. Aufgrund interner Konsultationen und einer gründlichen Prüfung Ihres Antrags ist eine längere Frist erforderlich. The European Commission's failure to reply to a request for public access to documents related to the purchase of the BioNTech-Pfizer COVID-19 vaccine Dear Mr Antragsteller/in, You submitted a complaint to the European Ombudsman against the European Commission about its failure to reply to your request for public access to documents concerning an offer for the purchase of COVID-19 vaccines. We have asked the Commission to reply to your request by 27 October 2021. At this stage, our inquiry concerns exclusively the Commission's failure to reply to your request. We would also like to inform you of the following procedural aspects relevant to your complaint. You might be aware that, in accordance with Regulation 1049/2001<https://eur-lex.europa.eu/legal-content/EN/ALL/?uri=celex%3A32001R1049>, there are two stages for dealing with requests for public access to documents - the initial stage and the confirmatory stage. The Commission has informed us that your request is still being treated as an initial application, even though the statutory time-limit for replying has now elapsed. That having been said, the Commission's failure to reply to your initial application within the prescribed time-limit entitles you to make a confirmatory application. You can choose to wait for the Commission's initial reply, and make a confirmatory application if you are dissatisfied with its response. This would allow you to know the position of the Commission on the substance of your request. As mentioned above, we have asked the Commission to come back to you by 27 October 2021. Alternatively, you can make a confirmatory application without waiting for the Commission's initial reply. Once you have submitted a confirmatory application, the Commission should reply within 15 working days, or within 30 working days if there is a reasoned justification for extending the deadline. If there is no response within this time period, this may be treated as an implicit refusal of the request. Decision on the European Commission's failure to reply to a request for public access to documents related to the purchase of the BioNTech-Pfizer COVID-19 vaccine - GESTDEM 2021/0863 Dear Mr Antragsteller/in, You submitted a complaint to the European Ombudsman against the European Commission about its failure to reply to your request for public access to documents concerning an offer for the purchase of COVID-19 vaccines. We informed the Commission of your complaint and asked it to send you a reply. The Commission has informed us that it has sent you an initial reply to your access request on 27 October 2021. The case is therefore closed with the conclusion that it has been settled. Please note that this inquiry concerned exclusively the Commission's failure to reply to your correspondence.
