This is a reply to your application for access to documents as registered by EMSA on 27 August 2021.
Concerning your request for documents linked with the aforementioned European Space Agency (ESA) project, please find attached a redacted version of EMSA’s contribution to this project.
Please note that parts of the document cannot be disclosed as per Regulation (EC) No 1049/2001 of the European Parliament and of the Council regarding public access to documents, Article 4 “Exceptions” and specifically:
1. The institutions shall refuse access to a document where disclosure would undermine the protection of:
a) the public interest as regards:
— public security

— the purpose of inspections, investigations and audits.
6. If only parts of the requested document are covered by any of the exceptions, the remaining parts of the document shall be released.
The justification for this partial disclosure concerns the fact that the document includes operational details that could provide insights on the modus operandi of surveillance operations, or on limitations of current surveillance capabilities, that could potentially jeopardize public security and affect on-going and future surveillance activities.
Concerning your request for the final report of this project, the Agency has never received it, does not have it in its possession and cannot therefore disclose it. We kindly suggest that you direct this request to ESA.
Note that, in line with Article 7(2) of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents, you may file a confirmatory application within 15 working days of receiving this email.
