You have requested access to *any and all** documents held by DG FISMA in the time frame of 1 January 2018 – 4 April 2023 mentioning Chatham House rules and/or the Chatham House rule, including all agendas of meetings, meeting reports, correspondence of any kind such as e-mails (including all attachments), briefings, presentations, notes and reports of any kind*. Your application concerns a very large number of documents, which need to be retrieved and assessed individually. Many of these documents originate from third parties who need to be consulted and requested agreement for disclosure. Such processing cannot be carried out within the normal time limits set out in Article 7 of Regulation (EC) No 1049/2001. Furthermore, Article 6(3) of Regulation (EC) No 1049/2001 provides for a possibility to confer with the applicant informally with a view to finding a fair solution when an application relates to a very long document or concerns a very large number of documents. In such cases, the applicant may specify the application by narrowing down its subject matter or timeframe covered to reduce it to a more manageable number of documents. To help you in narrowing the scope of your application so we can respond to your request in a reasonable period of time, we would like to propose that your request covers only documents within the timeframe of 1 January 2023 to 27 November 2023. Dear Ms Izuzquiza, We are writing concerning your request for access to Commission documents registered on 27 November 2023 under case number EASE 2023/7068. We refer to our letter of 5 December 2023, in which we invited you, pursuant to Article 6(3) of Regulation (EC) No 1049/2001, to propose a fair solution for dealing with your request. We explained that such a fair solution could consist of narrowing down the scope of your request (i.e. the subject matter(s) and/or timeframe covered), so as to reduce it to a more manageable amount of documents. We have not received any reply from you to the fair solution proposed. As announced in our letter, we have therefore proceeded to the unilateral restriction of the scope of your application to the documents in the timeframe of 1 January 2023 to 27 November 2023. Based on the information available we could not identify any other conceivable way of dealing with your application. Furthermore, let us inform you that we are working on your application. However, we have not yet been able to gather all the elements necessary to carry out a full analysis of your request. We will not be able to send you the reply within the prescribed time limit expiring on 18 December 2023. In particular, part of the documents requested originate from third parties which must be consulted.
