Documents of the HLG on access to data for effective law enforcement and of its sub-groups
Dear Sir or Madam,
With regard to the »High-Level Group (HLG) on access to data for effective law enforcement« and its sub-groups, please send me all relevant documents as described below that are not yet available on the group's dedicated website [1]:
· all relevant documents from 1 January 2024 (according to point 12 of the rules of procedure of the group [2] and article 26 of Commission Decision C(2016)3301 [3]), including, but not limited to:
· minutes, agendas, reports,
· participant lists of the meetings of the group and its sub-groups,
· participants’ submissions (including presentations),
· documents that have been discussed or are scheduled for discussion and
· emails, conclusions, draft conclusions and interim reports
Please include all types of documents, in particular, but not limited to: minutes, protocols, schedules, presentations, work papers, notes, emails, drafts, summaries, answers and announcements of dates for further meetings related to the group's work.
There is an overriding public interest in disclosure of these documents as defined in article 4 of Regulation (EC) No 1049/2001 [4]: Subject of the work of the »High-Level Group (HLG) on access to data for effective law enforcement« and its sub-groups are issues that affect the fundamental rights of all EU citizens who communicate digitally.
The right to privacy or private life is enshrined in the Universal Declaration of Human Rights (Article 12), the European Convention of Human Rights (Article 8) and the European Charter of Fundamental Rights (Article 7).
Especially since the group is going to "Propose recommendations for the further development of Union policies and legislation to enhance and improve access to data for the purpose of effective law enforcement. In this context: contribute to integrating a law enforcement perspective, including privacy and data protection requirements, in all relevant EU policies and actions (‘security by design’)." [5]
There is an overriding public interest in the associated topics such as data retention, access to data at rest in a user’s device, access to data at rest in a provider’s system, access to data in transit, encryption and privacy of communication, as political debates in the EU and Member States, historical and current landmark judgements (e. g.: ECJ rulings on data retention, ECHR ruling on encryption (PODCHASOV v. RUSSIA ) etc. ), media reports about the HLG (e. g.: euronews, netzpolitik.org etc.), NGO work (open letter by EDRi and others) and more than 130 participants at the Public Consultation meeting of the High-Level Group on Tuesday 20 February 2024 show. Making these documents available does not affect public or private interests; presentations and participant lists, among others, have already been made available without any form of harmful interference.
