Dear Ombudsman Office, I would like to complain about the European Border Agency Frontex handling my access to documents requests under EU regulation 1049/2001 and 1367/2006, which I submitted on the 14th January 2022 via the portal FragDenStaat together with Iftach Cohen as a co-applicant. The correspondence can be viewed here: 1. https://fragdenstaat.de/anfrage/documents-regarding-rbi-aegean/ 2. https://fragdenstaat.de/anfrage/correspondence-18-19-april-2020-incident/ 3. https://fragdenstaat.de/anfrage/operational-plan/ On the 18th January 2022 Frontex acknowledged receipt of these applications, processing them as cases cases PAD-2022-00020, PAD-2022-00021, and PAD-2022-00022. On the 18th February 2022 I asked Frontex, whether my requests are being processed with the Transparency Office responding, that they are still waiting for the proof of identification of the co-applicant. However, the co-applicant has already sent his ID on the 28th of January 2022, which I wrote to Frontex. You can find a proof of the sent mail attached. Subsequently, Frontex offers to only process the application under my name. I hereby submit a complaint to the European Ombudsman and request the European Border Agency Frontex to register and process my application without any further delay as me and the co-applicant have sent our proof of identification months ago and don’t want to see our requests kept paralysed in such a way. Dear Ms Bazgan, You recently submitted a complaint to the European Ombudsman about how the European Border and Coast Guard Agency (Frontex) dealt with your requests for public access to documents. In January 2022, you, together with a co-applicant, made three requests 1 for public access to documents to Frontex. Frontex acknowledged receipt of these requests and asked your co-applicant for proof of identification. You were not asked to provide such a proof, as you had already done so in the context of a previous request. On 28 January 2022, your co-applicant sent a copy of his passport to Frontex. It seems, however, that Frontex has not received this email. In February 2022, you asked Frontex to confirm that it was processing your request. When Frontex informed you that it had not yet received the requested proof of identification for your co-applicant you offered to send proof of the email he had sent at the end of January. However, Frontex did not reply. In April 2022, Frontex stated that it had still not received your co-applicant's proof of identification and offered to process the three requests for public access under your name only. Dissatisfied with this reply, you turned to the Ombudsman.
