June and November Meetings of the HLEG on access to data for effective law enforcement

Dear Sir or Madam,

With regard to the meeting of the »High-Level Expert Group on access to data for effective law enforcement« on 19 June 2023 and 21 November 2023, please send me all relevant documents as described below:

· documents relevant for the following topics: data retention, IP addresses, encryption and access to communication data,
· documents that have been discussed or are scheduled for discussion,
· documents on the group's subgroups including members and scope of subgroups,
· presentations that have been given or are planned,
· documents on the schedule of the meetings of the group and subgroups and
· conclusions, draft conclusions, reports, interim reports and all other documents that reflect the state of affairs in this group and in the subgroups.

Please include all types of documents, in particular, but not limited to: presentations, work papers, notes, emails, drafts, summaries, answers and announcements of dates for further meetings related to the group's work.

Dear Dr Breyer, We are writing concerning your request for access to Commission documents registered on 18-09-2023 under case number 2023/5384. We are currently working on your request. However, we have not yet been able to gather all the elements necessary to carry out a full analysis of your request. We will not be able to send you the reply within the prescribed time limit expiring on 09-10-2023 because, in order to retrieve the documents requested, large files have to be examined. Participants List, Working Group 1, European Commission, reference Ares(2023)7247220 (hereafter ‘document 18’), 19. Participants List, Working Group 2, European Commission, reference Ares(2023)7247240 (hereafter ‘document 19’), 20. Participants List, Working Group 3, European Commission, reference Ares(2023)7247269 (hereafter ‘document 20’) I would like to justify full disclosure of these documents on the basis of the particular public interest in the participant lists as follows: According to a press report [3] that was discussed, shared and commented on by citizens online various NGOs have approached the group and asked to participate in the group's work to no avail. Also on social media citizens expressed the wish to know about who is participating in the group’s meetings very intense and strikingly numerous [4]. Only with detailed informations about the group's participants and invited participants citizens and organised civil society can interact with the "collaborative and inclusive platform" as provided for in the group's scoping paper [5] and elsewhere. In view of the relevance, the sensitivity and the controversial nature of the topics dealt with by the group (among others: access to data at rest in a user’s device (Working Group 1 ), access to data at rest in a provider’s system (Working Group 2) and access to data in transit (Working Group 3)) that potentially effect every citizen in the European Union, it is necessary for civil society to be able to communicate and exchange ideas with the participating organisations. Already by mid-2024, the group is expected to "Propose recommendations for the further development of Union policies and legislation to enhance and improve access to data for the purpose of effective law enforcement. In this context: contribute to integrating a law enforcement perspective, including privacy and data protection requirements, in all relevant EU policies and actions (‘security by design’)." [6] This is particularly the case because the Group's special status means that transparency is limited. Unlike a regular group, the group is not listed on the Register of Commission Expert Groups and Other Similar Entities, nor are its subgroups. In addition, minutes have not yet been published, contrary to Point 13 of the rules of procedure of the High Level Group [7]. The documents published in response to my enquiry show that participants in the group are quite willing to share information with the public. But the participants must be known to be asked and contacted by NGOs, academia, companies and citizens. A lack of transparency is likely to cause speculations and uncertainty in the media and the public about who is working in the HLG on the highly sensitive issues mentioned above. The legitimate interests of the data subject would in no way be prejudiced if at least the exact company, institution or authority and the department as well as contacts are disclosed. For these reasons, I would ask you to reconsider your decision and to disclose detailed information about the group's participants and invited experts.
