Dear applicant, Kindly find that EMSA already took note of an application with the same subject matter, back in April 2022. The reference number of the respective application is # 224425/ 6 July 2021. As you have addressed you request to <<E-Mail-Adresse>><mailto:<<E-Mail-Adresse>>>, there was a delay in its identification as request for public access to documents, for which we would like to convey our sincere apology. We would like to draw your attention to the fact that, for applications in the remit of Regulation (EC) No 1049/2001, the channel to be used is: EMSA website/ Publications/ EMSA Documents/Documents Request Form, that will ensure a prompt handling. Kindly find attached our clarifications email sent at the time and the delivery receipt confirming our email was properly delivered to the recipient email address. This application was not processed further as there was no reply clarifying the scope. We reiterate our clarification request, namely: Firstly, kindly clarify if you are seeking access to documents containing the “definition of "Multipurpose Maritime Operations" (MMO) from the agencies EMSA, Frontex and EFCA”, or you are looking just for the “definition” itself as information independent of any document. Secondly, in case you are seeking access to documents. please also note that, in line with the provisions of Regulation (EC) No 1049/2001, “applications for access to a document shall be made in any written form, including electronic form, in one of the languages referred to in Article 314 of the EC Treaty and in a sufficiently precise manner to enable the institution to identify the document.” Considering the above legal basis, it is EMSA’s assessment that the subject matter of your request is not defined “in a sufficiently precise manner” as to enable the Agency to identify the document(s) being requested. Concluding on this second point, be so kind to clarify the subject matter of your application by: -Clearly identifying the documents you want access to; -Add any other relevant references/information which might enable EMSA to identify the document(s) you are asking access to. Moreover - confirm that the two applications (#224425 and #224426) are covering the same subject matter and indicate to which of the emails should EMSA communicate via/ reply to, moving forward with the processing: <<E-Mail-Adresse>><mailto:<<E-Mail-Adresse>>> or <<E-Mail-Adresse>><mailto:<<E-Mail-Adresse>>>? Once the scope of your application is clarified EMSA will proceed with registration and processing of your application in line with the applicable legal regime. Ich suche Zugang zu Dokumenten den Begriff "Mehrzweck-Schiffsbetrieb" (MMO) der Agenturen EMSA, Frontex und EFCA" enthalten. Daraus erhoffe ich mir Informationen über das Konzept. Dear applicant, Once again, thank you for your interest in the activities of the European Maritime Safety Agency (EMSA). Please be informed that in line with the provisions of Article 7.3 of Regulation (EC) No 1049/2001 of the European Parliament and of the Council regarding public access to documents, EMSA extends the initial time limit (i.e. 26 October 2022) by an additional 15 working days due to the fact that complete processing of your application was not possible for the below stated reason: - Given the scope as clarified, processing of your application involves consultations with third parties (EU Agencies). Note that the 1st and 2nd of November are EMSA bank holidays, therefore these two days will not be taken into account when calculating the additional 15 working days’ time-line.
