Please be informed that the documents to which you seek access falls under a general presumption [1] as it contains information that is subject to an ongoing - investigation within the meaning of Article 4(2) third indent of Regulation (EC) No 1049/2001; [2] and - decision-making process within the meaning of Article 4(3) of Regulation (EC) No 1049/2001. [3] In consequence, to ensure the proper functioning of the investigative and decision-making procedures in question and to guarantee that their objectives are not compromised as well as to avert the risk that they are prejudiced through any interference of third parties, the release of the document is preluded.
