In that request, with a view to finding a fair solution, we had provided you with a list of 62 documents potentially falling within the scope of your public access request and asked you to identify which documents are relevant to your inquiry and send us your feedback by 13 December. In light of the above, as requested, all documents now identified as falling within the scope of your initial public access request are currently being assessed. While processing your public access request, and in light of the initial deadline of today 19 December 2023, additional aspects such as ongoing consultations with stakeholders and the very large number of documents prolonged the process. Therefore, and in line with Article 3(2) of the Management Board Rules on Public Access to Europol Documents, an extension for up to 15 working days is necessary in order for us to properly handle your request. The deadline for our final reply to you is thus 18 January 2024, taking into account the official holidays of Europol. Partial access granted: With regard to 42 documents, we are pleased to inform you that partial access has been granted, herewith attached in the enclosed zip files, as follows: • Concerning EDOC# 1261466, EDOC#1357398, EDOC#1357409, EDOC#1357414, EDOC#1357424, and EDOC#1331949, redactions have been made to a minor extent (indicated throughout the text in black shapes ‘[…]’) by removing registration modalities to the events, as per standard practice, on the basis of Article 4(1)(a) first indent of the Decision of the Management Board of Europol laying down the rules for applying Regulation 1049/2001 with regard to Europol documents (‘MB Decision on Public Access’), of which you were already provided a copy. No access granted: With regard to 17 documents, we regret to inform you that Europol has decided to refuse access to them for the following reasons: • As regards EDOC#1122833, EDOC#1122215, and EDOC# 1362028, access to these documents is being refused since their release would reveal sensitive strategic and planning information and preliminary consultations on the internal processes related to producing the TE-SAT reports. Accordingly, access to these documents cannot be granted, in light of Article 4(1)(a) first indent of the MB Decision on Public Access, as it would undermine the protection of the public interest as regards public security such as the proper fulfilment of Europol’s tasks. In particular, disclosure would have a negative impact on the internal work processes at Europol as well as jeopardize Member States’ and other Europol’s partners’ trust, which is essential to Europol’s activities, consequently preventing Europol from fulfilling its tasks in relation to the TE-SAT. Moreover, access is also being refused on the basis of Article 4(3) of the MB Decision since these documents were drawn up for internal use of the TE-SAT Advisory Board and a limited audience and they refer to some matters on which certain decisions have not yet been adopted, therefore, disclosure would seriously undermine ongoing and future decision-making processes on such matters. No overriding public interest in the disclosure of these three documents was identified in this regard. Finally, EDOC#1122833 and EDOC# 1122215, mentioned above, also contain personal data of some Europol staff members and thus access to these two documents is being refused additionally on the basis of Article 4(1)(b) of the MB Decision on Public Access as their disclosure would undermine the protection of the public interest as regards the privacy and integrity of the individuals mentioned therein. • Concerning all documents containing the TE-SAT Advisory Board meetings’ minutes, conclusions, final reports and summaries of discussion (i.e.EDOC#188737, EDOC#278911, EDOC#297066, EDOC#298953, EDOC#371925, EDOC#424999, EDOC#455191, EDOC #477286, EDOC#113839, EDOC#190325, EDOC#399130, EDOC#1357403), access to all these documents is being refused on grounds of Article 4(1)(a) first indent of the MB Decision on Public Access, since their disclosure would undermine the protection of the public interest as regards the proper fulfilment of Europol’s tasks. It is noted that these documents were not meant for external distribution as they contain sensitive information about the single deliberations and positions expressed by various members of the TE-SAT Advisory Board at a working level, in a trusted environment. Therefore, the disclosure of these documents to the public would significantly jeopardize the trust of Member States and Europol’s partners into the established format of the Advisory Board’s meetings and discussions, which is essential to Europol’s activities, consequently preventing Europol from performing its tasks including in relation to the TE-SAT. Article 4(1)(b) of the MB Decision on Public Access is also applicable to all of these documents as their disclosure to the public would reveal the personal data of meetings’ participants therefore undermining the public protection of the public interest as regards the privacy and integrity of these individuals. • With respect to EDOC#1357399 and EDOC#1350771, access to these two documents is being refused on the basis of Article 4(1)(a)first indent of the MB Decision on Public Access since their disclosure would undermine the protection of the public interest as regards the proper fulfilment of Europol tasks. In particular, the documents in questions are power point presentations for recent TE-SAT Advisory Board meetings, which include provisional elements of proposed timelines and topics placed under discussion, such as proposals concerning internal working processes, which are still under discussion. Consequently, disclosure of these documents is being refused because it would be detrimental to the trust placed in Europol by members of the TE-SAT Advisory Board, which is essential to Europol’s activities, consequently preventing Europol from performing its tasks including in relation to the TE-SAT. Moreover, access to these two documents is being refused additionally on the basis of Article 4.3 of the MB Decision on Public Access since by these two presentations were prepared for internal use of Europol, the TE-SAT Advisory Board and a limited audience, and the elements covered by them are subject to ongoing discussions, meaning that decisions on all such elements have not yet been taken. Thus, access would seriously undermine current and future decision-making processes on the matters covered in these two presentations. No overriding public interest in the disclosure of these documents has been identified. • For all of the reasons explained above, partial access to the documents to which access is being denied was also determined not to be possible. You may make a confirmatory application asking Europol to reconsider its position within 15 working days of receiving Europol’s reply, in accordance with Article 5(4) of the MB Decision on Public Access. Dear Mr. << Antragsteller:in >>, As regards your confirmatory application of 6 February 2024, please be informed that the Executive Director, as the foreseen authority to decide upon confirmatory applications, finds no grounds to deviate from Europol's original assessment regarding documents EDOC#1122215, EDOC#1122833 and EDOC#1362028, which are the object of your confirmatory application, for the reasons already expressed in the reply of 17 January 2024 to your initial public access request, which remain valid. Moreover, considering that, for the same reasons explained in the reply of 17 January 2024, the vast majority of the content of each of the above-mentioned three documents is highly sensitive and would need to be redacted extensively, partial access would be meaningless. Therefore, the Executive Director has decided to maintain the decision to refuse access to documents EDOC#1122215, EDOC#1122833 and EDOC#1362028. This decision was taken after careful consideration of your written submissions and an ad hoc re-assessment of the consequences of the disclosure of the documents against the interests protected under Article 4 of the Management Board Decision laying down the rules for applying Regulation 1049/2001 with regard to Europol documents.
